MINUTES OF THE COMMISSION MEETING

Chairman Gary Hanson called the meeting to order. Present were: Commissioners: Chris Nelson and Kristie Fiegen; Commission Counsel: John Smith; Commission Advisor: Greg Rislov; Staff Attorneys: Karen Cremer and Kristen Edwards; Staff Analysts: Patrick Steffensen, Brittany Mehlhaff, Darren Kearney, Jason Simmons, Eric Paulson, Robin Meyerink, and David Henry; and Staff: Sherry Dickerson

Also present were:
Lee Magnuson, Lindquist, Vennum, PLLP, representing Black Hills Power, Inc.; Andrew Moratzka, Stoel Rives LLP, representing Black Hills Industrial Intervenors; Mark Moreno, Schmidt, Schroyer, Moreno, Lee & Bachand, P.C, representing Black Hills Industrial Intervenors; Kyle White, Todd Brink, Chris Kilpatrick, Chuck Loomis, Mike Theis, Vance Crocker, Wendy Moser, Melanie Toney, and Amy Koenig, Black Hills Power, Inc.; and Jill Tietjen, Technically Speaking, Inc., representing Black Hills Power, Inc.

1.     EL12-061     In the Matter of the Application of Black Hills Power, Inc. for Authority to Increase its Electric Rates (Staff Analysts: Brittany Mehlhaff, Patrick Steffensen; Staff Attorneys: Karen Cremer, Kristen Edwards)

     Commissioner Fiegen moved to grant BHP's and Wal-Mart's Joint Motion for Approval of Settlement Agreement. Motion carried 3-0.

      Commissioner Nelson moved to grant BHP's and Black Hill Industrial Intervenors' Joint Motion for Approval of Settlement Agreement. Motion carried 3-0.

     
      Commissioner Nelson moved to grant Staff's and BHP's Joint Motion for Approval of Settlement Stipulation. Motion carried 3-0.

2.     EL12-062     In the Matter of the Application of Black Hills Power, Inc. for the Phase in of Rates Regarding Construction Financing Costs of Cheyenne Prairie Generating Station (Staff Analysts: Brittany Mehlhaff, Patrick Steffensen; Staff Attorneys: Karen Cremer, Kristen Edwards)

     Commissioner Hanson moved to grant BHP's and Black Hill Industrial Intervenors' Joint Motion for Approval of Settlement Agreement. Motion carried 3-0.

     Commissioner Hanson moved to grant Staff's and BHP's Joint Motion for Approval of Settlement Stipulation. Motion carried 3-0.
