MINUTES OF COMMISSION HEARING

Commissioner Chris Nelson called the meeting to order. Present were Commissioner: Gary Hanson; Commission Attorneys: Karen Cremer and Adam de Hueck; Commission Advisor: Greg Rislov; Staff Attorney: Amanda Reiss; Staff Analysts: Brittany Mehlhaff and Darren Kearney; Grain Warehouse Manager: Cody Chambliss; Staff: Mikayla Frick.

Joining the meeting by telephone were Commissioner: Kristie Fiegen; Staff Attorney: Kristen Edwards; Staff Analyst: Jon Thurber; Consumer Affairs Staff:  Deb Gregg; Al Lubeck, Qwest Corporation dba CenturyLink QC; Mollie Smith, Fredrikson & Byron representing Crocker Wind Farm, LLC; Jenny Monson-Miller, Crocker Wind Farm, LLC; John Mullen, representing Roslyn Elevator; Marcia and Steve Schmidt, Roslyn Elevator; Charlie Nelson, Ballard Spahr representing US Bank; John Phillipi, US Bank.  

Administration

         1.    Approval of the Minutes of the Commission Meeting Held on May 24, 2022 (Staff: Janeth Merriman)

        Commissioner Fiegen moved to approve the Minutes of the Commission Meeting held on May 24, 2022. Motion carried 3-0.

Consumer Reports

  1. Status Report on Consumer Utility Inquiries (Consumer Affairs: Deb Gregg)

The Commission received a total of 38 contacts since the last report was prepared for the May 24, 2022, Commission meeting.

Eight contacts were related to telecommunications services, five contacts were related to electric services, eight contacts were related to wireless services, one contact was related to natural gas services, one contact was related to gas and electric services, three contacts were related to the Do Not Call Registry, one contact was related to carbon pipelines, three contacts were referred to One Call and eight contacts were related to issues not regulated by the PUC.

821 of the 838 contacts received in 2022 have been resolved.

Telecommunications

1.      TC22-010        In the Matter of the Filing of Qwest Corporation dba CenturyLink QC for Approval of Revisions to Its Access Service Tariff (Staff Analyst: Brittany Mehlhaff; Staff Attorney: Kristen Edwards)

       Mr. Al Lubeck, Qwest Corporation dba CenturyLink QC (CenturyLink), requested the Commission approve CenturyLink’s revisions to its Access Service Tariff with an effective date of July 1, 2022. Ms. Brittany Mehlhaff, staff analyst, recommended the Commission approve the company’s request with an effective date of July 1, 2022.

        Commissioner Fiegen moved to approve the requested tariff changes with an effective date of July 1, 2022. Motion carried 3-0.

Electric

1.      EL17-055        In the Matter of the Application by Crocker Wind Farm, LLC for a Permit of a Wind Energy Facility and a 345 kV Transmission Line in Clark County, South Dakota, for Crocker Wind Farm (Staff Analysts: Darren Kearney, Jon Thurber; Staff Attorneys: Kristen Edwards, Amanda Reiss)

        Ms. Mollie Smith, representing Crocker Wind Farm, LLC (Crocker), requested the Commission waive the decommissioning requirement in Condition 37 of Crocker’s permit for nine turbines, which are located on federal grassland easements. Following a lengthy discussion and questions from the Commission, Ms. Smith requested the docket be deferred to allow Crocker to gather more information from the landowners.

         Chairman Nelson deferred the docket to a later meeting.

Grain Warehouse

1.      GW22-002    In the Matter of Roslyn Elevator, Roslyn, South Dakota (Grain Warehouse Manager: Cody Chambliss; Staff Attorney: Amanda Reiss)

         Chairman Nelson deferred the docket to a later meeting.

There being no further business, at the hour of 2:46 p.m., the South Dakota Public Utilities Commission meeting adjourned.
