1.      TC22-010        In the Matter of the Filing of Qwest Corporation dba CenturyLink QC for Approval of Revisions to Its Access Service Tariff (Staff Analyst: Brittany Mehlhaff; Staff Attorney: Kristen Edwards)

         On May 19, 2022, the Commission received a filing by Qwest Corporation dba CenturyLink QC for approval of revisions to its Access Service Tariff. This filing proposes the second step in implementing the 8YY Access Service reductions mandated in the Federal Communications Commission’s October 9, 2020, Report and Order in WC Docket No. 18-156, FCC Release No. 20-143. CenturyLink QC requests an effective date of July 1, 2022.

         TODAY, shall the Commission approve the requested tariff changes?

1.      EL17-055        In the Matter of the Application by Crocker Wind Farm, LLC for a Permit of a Wind Energy Facility and a 345 kV Transmission Line in Clark County, South Dakota, for Crocker Wind Farm (Staff Analysts: Darren Kearney, Jon Thurber; Staff Attorneys: Kristen Edwards, Amanda Reiss)

         On December 15, 2017, Crocker Wind Farm, LLC (Crocker) filed with the Commission an Application for an energy facility permit and a 345 kV Transmission Line (Projects) to construct the Crocker Wind Farm, a wind energy facility located on approximately 29,331 acres of privately owned land in Clark County, South Dakota, approximately 8 miles north of Clark, South Dakota. On May 9-11, 2018, an evidentiary hearing was held regarding this matter. On June 12, 2018, the Commission issued a Final Decision and Order Granting Permit to Construct Facilities (Permit). The Projects began commercial operations in November 2019. Condition 37 of the Permit required Crocker to file an escrow account plan with the Commission for Commission approval. On November 29, 2018, the Commission issued an Order Approving Escrow Agreement. On May 23, 2022, Crocker filed an Exemption Request and Request for Modification of Escrow Account Plan and Escrow Agreement. 

         TODAY, shall the Commission grant Crocker Wind Farm, LLC’s Exemption Request and Request for Modification of Escrow Account Plan and Escrow Agreement?

Grain Warehouse

1.      GW22-002      In the Matter of Roslyn Elevator, Roslyn, South Dakota (Grain Warehouse Manager: Cody Chambliss; Staff Attorney: Amanda Reiss)

On February 3, 2022, staff filed a Petition to Suspend the Grain Buyer License pursuant to SDCL 49-45-16 and to seek receivership pursuant to SDCL 49-45-16.1 of Roslyn Elevator, Roslyn, South Dakota (Roslyn). The filing stems from a change in Roslyn’s financial position and resulting acts of insolvency that require immediate action. On February 15, 2022, the Commission issued an Order Suspending Grain Buyer License; Order to Apply to the Circuit Court to Appoint a Receiver. Roslyn submitted a complete application for a FY23 grain buyer license.

TODAY, shall the Commission take action on Roslyn’s FY22 grain buyer license? AND shall the Commission grant Roslyn a FY23 grain buyer license? OR how shall the Commission proceed?

All who offer public comments are requested to sign in at the commission meeting or let the commission know of their wish to speak when they call in to reserve a phone line. Time limits for comments may be determined at the discretion of the commission.

Announcements

1.   The PUC office will be closed Monday, June 20, 2022, in observance of Juneteenth.

2.   Commissioners will make a presentation at the South Dakota Rural Electric Cooperative Association’s Managers Meeting and Legal Seminar on Tuesday, June 28, 2022, at 4:00 p.m. CDT at Arrowwood Cedar Shore Resort, Oacoma, South Dakota.

3.   The PUC office will be closed Monday, July 4, 2022, in observance of Independence Day.

4.   The next regular commission meeting will be Tuesday, July 5, 2022, at 1:30 p.m. CDT in Room 413 at the State Capitol Building, Pierre, South Dakota.

5.   Commission meetings are scheduled for July 19 and August 2, 2022.
