1. EL16-021 In the Matter of the Complaint by Juhl Energy, Inc. against NorthWestern Corporation dba NorthWestern Energy for Establishing a Purchase Power Agreement (Staff Analysts: Darren Kearney, Joseph Rezac, Jon Thurber; Staff Attorneys: Kristen Edwards, Amanda Reiss)
On June 23, 2016, Juhl Energy, Inc. (Juhl) filed a Complaint seeking resolution of a dispute with NorthWestern Corporation dba NorthWestern Energy (NorthWestern) regarding the proper avoided cost for a long-term electric power purchase agreement. On August 4, 2016, the Parties filed a Joint Request for a Procedural Schedule. At its regularly scheduled meeting on August 16, 2016, the Commission established a Procedural Schedule.
TODAY, shall the Commission give the Executive Director authority to enter into a consulting contract not to exceed $38,000?
2. EL16-030 In the Matter of the Petition of Otter Tail Power Company for Approval of the Environmental Cost Recovery Rider Charge (Staff Analysts: Eric Paulson, Joseph Rezac; Staff Attorney: Amanda Reiss)
On August 31, 2016, the Commission received an application by Otter Tail Power Company (Otter Tail) for approval of its annual update to the Environmental Cost Recovery Rate under Otter Tail’s Environmental Cost Recovery Rider, Rate Schedule 13.08, for the actual and forecasted cost and revenue through the recovery period of November 2016 through October 2017 for Big Stone Plant’s Air Quality Control System (AQCS) and Hoot Lake Plant’s Mercury and Air Toxics Standards (MATS). Otter Tail states the rate impact of this request (for both projects) will decrease the ECR Rider Rate from $0.00643 per kWh to $0.00536 per kWh. The bill decrease for a typical residential customer averaging 955 kWh per month will be approximately $1.02 or 1.15%. On September 15, 2016, the Commission issued an Order Assessing Filing Fee. On September 29, 2016, Otter Tail filed a revised application.
TODAY, shall the Commission approve Otter Tail Power Company’s revised Environmental Cost Recovery Rider Charge and associated tariff revisions with an effective date of November 1, 2016?

1. TC16-005 In the Matter of the Application of Mobilitie Management, LLC for a Certificate of Authority to Provide Local Exchange Services in South Dakota (Staff Analyst: Lorena Reichert; Staff Attorney: Kristen Edwards)
On April 7, 2016, the Commission received a filing from Mobilitie Management, LLC (Mobilitie Management) requesting a Certificate of Authority to provide local exchange services in South Dakota for the purpose of providing transport, backhaul, and broadband data services to business customers and government agencies. Mobilitie Management requests authority throughout the territories of all ILECs open to competition that are not state designated as rural service areas. The company requests a waiver of ARSD 20:10:32:10. On May 25, July 25, and September 26, 2016, Mobilitie Management responded to staff’s data requests.
TODAY, shall the Commission grant Mobilitie Management’s request for a Certificate of Authority to Provide Local Exchange Services in South Dakota and requested waiver?
2. TC16-052 In the Matter of the Application of GoDaddy.com, LLC for a Certificate of Authority to Provide Interexchange Long Distance Services in South Dakota (Staff Analyst: Patrick Steffensen; Staff Attorney: Kristen Edwards)
On August 15, 2016, the Commission received a filing from GoDaddy.com, LLC (GoDaddy.com) requesting a Certificate of Authority to provide interexchange services in South Dakota. GoDaddy.com intends to provide resold interexchange services to customers throughout the entire state of South Dakota. On September 23, 2016, GoDaddy.com responded to staff’s data request. On October 12, 2016, GoDaddy.com submitted its indemnity bond.
TODAY, shall the Commission grant GoDaddy.com, LLC’s request for a Certificate of Authority to Provide Interexchange Services in South Dakota?
3. TC16-057 In the Matter of the Approval of a Lifeline/Link Up and Tribal Lifeline Amendment to the Interconnection Agreement between Qwest Corporation dba CenturyLink QC and Enventis Telecom, Inc. dba Consolidated Communications (Staff Analyst: Lorena Reichert; Staff Attorney: Amanda Reiss)
On September 30, 2016, the Commission received a filing pursuant to 47 U.S.C. § 252 for approval of a Lifeline/Link Up and Tribal Lifeline Amendment to the Interconnection Agreement between Qwest Corporation dba CenturyLink QC and Enventis Telecom, Inc. dba Consolidated Communications for the State of South Dakota.
TODAY, shall the Commission approve the amendment to the interconnection agreement?
4. TC16-058 In the Matter of the Filing by MCImetro Access Transmission Services Corp. dba Verizon Access Transmission Services for Approval of its Access Service Tariff No. 2 (Staff Analyst: Joseph Rezac; Staff Attorney: Amanda Reiss)
On October 5, 2016, the Commission received a filing from MCImetro Access Transmission Services Corp. dba Verizon Access Transmission Services (Verizon Access) for revisions to its Access Services Tariff No. 2. With this filing, Verizon Access changes its name from MCImetro Access Transmission Services LLC dba Verizon Access Transmission Services to MCImetro Access Transmission Services Corp. dba Verizon Access Transmission Services. Only the name has changed throughout the tariff. All terms, rates and conditions remain the same. Verizon Access requests a November 1, 2016, effective date. On October 17, 2016, Verizon Access filed revised tariff pages.
TODAY, shall the Commission approve the proposed tariff revisions?
