On April 4, 2013, Commission Staff filed an Electric Service Territory Boundary Agreement between Central Electric Cooperative, Inc. and Douglas Electric Cooperative, Inc. This filing is made pursuant to current efforts of the PUC to verify electric territory mapping data for conversion to electronic format and use in a Geographic Information System (GIS) database. With the assistance of the above-referenced utilities, Commission Staff has confirmed the service territory boundary shared by these utilities and has prepared updated mapping information. Commission Staff asks for approval of the agreement to update official mapping data to properly reflect the service territory boundaries shared by the utilities in this docket.

On May 5, 2014, Prelude, L.L.C. (Prelude) filed a complaint against Basin Electric Power Cooperative, Butte Electric Cooperative, Inc., Grand Electric Cooperative, Inc., Moreau-Grand Electric Cooperative, Inc., Rosebud Electric Cooperative, Inc., and Rushmore Electric Power Cooperative, Inc. (Respondents). Prelude has projects located in Respondents' service territories. Prelude alleges that Respondents have failed to enter into good faith negotiations of long term electric power purchase agreements, pursuant to the Public Utility Regulatory Policy Act of 1978. On May 23, 2014, the Commission received a Petition to Intervene from South Dakota Electric Utility Companies.

     TODAY, shall the Commission grant intervention to any parties that may have filed?

5.     EL14-043     In the Matter of the Request for Approval of an Electric Service Territory Boundary Agreement between Bon Homme Yankton Electric Association, Inc. and NorthWestern Corporation dba NorthWestern Energy. (Staff Analyst: David Henry; Staff Attorney: Kristen Edwards)

On May 12, 2014, Commission Staff filed an Electric Service Territory Boundary Agreement between Bon Homme Yankton Electric Association, Inc. and NorthWestern Corporation dba NorthWestern Energy. Gas & Electric

1.     GE12-001     In the Matter of the Filing by NorthWestern Corporation dba NorthWestern Energy for Approval of Tariff Revisions to its South Dakota Demand Side Management Plan (Staff Analyst: Brian Rounds; Staff Attorney: Karen Cremer)

On January 27, 2012, NorthWestern Corporation dba NorthWestern Energy (NWE) filed to revise its Demand Side Management (DSM) Plan that was approved in GE09-001. NWE filed an updated plan on December 6, 2012, and again on April 23, 2014. On May 6, 2014, NWE filed updated tariff sheets, requesting an effective date of June 1, 2014. On May 22, 23, and 28, 2014, NWE filed responses to Commissioner data requests and updated tariff sheets, requesting a new effective date of July 1, 2014.

     TODAY, shall the Commission approve the proposed two-year Demand Side Management Plan, including the associated tariff revisions, with an effective date of July 1, 2014?

Telecommunications

1.     TC13-109     In the Matter of Qwest Corporation dba CenturyLink QC's Petition for Approval of Non-Impaired Wire Center Lists Pursuant to the Triennial Review Remand Order (Staff Analyst: Robin Meyerink; Staff Attorney: Karen Cremer)

On September 5, 2013, Qwest Corporation dba CenturyLink QC (CenturyLink) petitioned the Commission to open an investigation to develop a Commission-approved initial list of non-impaired wire centers pursuant to the FCC's Triennial Review Remand Order, CC Docket No. 01-338, WC Docket No. 04-313 (FCC rel. February 4, 2005) and SDCL § 49-31-81. CenturyLink also filed a proposed protective agreement that it will offer to CLECs wishing to see the supporting information it files. On January 27, 2014, the Commission granted CenturyLink's request for a Protective Order and deferred further action so that CenturyLink could file procedures specific to South Dakota regarding the TRRO. The matter was re-noticed on the March 13, 2014, PUC Weekly Filing. On March 10, 2014, CenturyLink filed its South Dakota TRRO Procedures. By order dated April 16, 2014, the Commission approved CenturyLink's proposed South Dakota TRRO Procedures subject to CenturyLink filing a revised document incorporating changes requested by the Commission. CLECs had 30 days to raise any objections to CenturyLink's request for approval of its list of non-impaired wire centers. On April 17, 2014 and April 25, 2014, CenturyLink filed revised South Dakota TRRO procedures. No objections have been filed regarding CenturyLink's list of non-impaired wire centers.

2.     TC14-005     In the Matter of the Petition of Fiber Ring Revenue-Pooling Association for Approval of Amended Revenue Pooling Documents (Staff Analyst: Eric Paulson; Staff Attorney: Karen Cremer)

On March 3, 2014, the Commission received a petition from Fiber Ring Revenue-Pooling Association (FRRPA) requesting approval of revisions to its Intracompany Transport Use, Public Internet transport Use and an addition of a Redundant Capacity Use exhibit. On April 21, May 5, and May 29, 2014, FRRPA responded to staff's data request.

     TODAY, shall the Commission approve Fiber Ring Revenue-Pooling Association's Amended Revenue Pooling Documents?

3.     TC14-010     In the Matter of the Filing by AT&T Corp. for Approval of Revisions to its Access Service Tariff (Staff Analyst: Eric Paulson; Staff Attorney: Karen Cremer)

On April 10, 2014, the Commission received a filing from AT&T Corp. (AT&T) requesting approval of revisions to its access service tariff (VoIP). With this filing, AT&T proposes to edit language in its VoIP portion of the tariff.

     TODAY, shall the Commission approve AT&T Corp's Revisions to its Access Service Tariff (VoIP)?

4.     TC14-011     In the Matter of the Filing by Teleport Communications America, LLC for Approval of Revisions to its Access Service Tariff (Staff Analyst: Eric Paulson; Staff Attorney: Karen Cremer)

On April 10, 2014, the Commission received a filing from Teleport Communications America, LLC (TCAL) requesting approval of revisions to its access service tariff. With this filing, TCAL proposes to introduce Public Switched Telephone Network (PSTN) Interconnect Service and edit language in its access services tariff. On May 15, 2014, TCAL responded to staff's data request.

     TODAY, shall the Commission approve Teleport Communications America, LLC's Revisions to its Access Service Tariff?

4.     TC14-012     In the Matter of the Filing by Teleport Communications America, LLC for Approval of Revisions to its Access Service Tariff (Staff Analyst: Eric Paulson; Staff Attorney: Karen Cremer)

On April 10, 2014, the Commission received a filing from Teleport Communications America, LLC (TCAL) requesting approval of revisions to its access service tariff (VoIP). With this filing, TCAL proposes to edit language in its VoIP portion of the tariff.

5.     TC14-015     In the Matter of the Filing by Metropolitan Telecommunications of South Dakota, Inc. dba MetTel for Approval of Revisions of its Access Services Tariff No. 3 (Staff Analyst: Robin Meyerink; Staff Attorney: Kristen Edwards)

On May 5, 2014, the Commission received a filing from Metropolitan Telecommunications of South Dakota, Inc. dba MetTel proposing revisions to its Competitive Access Provider Services Tariff Number 3. The purpose of this filing is to comply with the Federal Communications Commission in its Report and Order in WC Docket Nos. 10-90, etc., FCC Release No. 11-161 issued November 18, 2011. MetTel is requesting an effective date of July 1, 2014.

     TODAY, shall the Commission approve the proposed tariff revisions?

6.     TC14-016     In the Matter of the Filing by Granite Telecommunications, LLC for Approval of Revisions of its Access Services Tariff No. 3 (Staff Analyst: Robin Meyerink; Staff Attorney: Karen Cremer)

On May 7, 2014, the Commission received a filing from Granite Telecommunications, LLC (Granite) proposing revisions to its switched exchange access tariff, South Dakota P.S.C. Tariff No. 3. Granite is requesting an effective date of July 1, 2014.
