Consumer Reports

1.     Status Report on Consumer Utility Inquiries and Complaints Received by the Commission (Consumer Affairs: Deb Gregg)

Electric

1.     EL12-061     In the Matter of the Application of Black Hills Power, Inc. for Authority to Increase its Electric Rates (Staff Analysts: Jon Thurber, Brittany Mehlhaff, Patrick Steffensen, Staff Attorneys: Karen Cremer, Kristen Edwards)

On December 17, 2012, the Commission received an application by Black Hills Power, Inc. (BHP) for approval to increase rates for electric service to customers in its South Dakota service territory by approximately $13.7 million annually or approximately 9.94% based on BHP's test year ending June 30, 2012. The Company states a typical residential electric customer using 650 kWh per month would see an increase of $7.11 per month. The proposed changes may potentially affect approximately 65,000 customers in BHP's South Dakota service territory. On January 13, 2013, GCC Dacotah, Inc., Pete Lien & Sons, Inc., Rushmore Forest Products, Inc., Spearfish Forest Products, Inc., and Rapid City Regional Hospital filed a Petition to Intervene.

     TODAY, shall the Commission grant intervention to any parties that may have filed?

Natural Gas

1.     NG12-007     In the Matter of the Filing by Montana-Dakota Utilities Co. for Approval of its Revised Conservation Tracking Adjustment (Staff Analyst: Patrick Steffensen, Staff Attorney: Kristen Edwards)

On December 7, 2012, the Commission received an application by Montana-Dakota Utilities Co. for approval of a revised Conservation Tracking Adjustment (CTA), pursuant to the terms of the Company's Conservation Program Tracking Mechanism Rate 90 tariff. On January 9, 2013, Montana-Dakota Utilities Co. filed its Revised Exhibits 1-5 and Responses to Staff's first data request. On January 22, 2013, Montana-Dakota Utilities Co. filed further Revised Exhibits 1-5.

     TODAY, shall the Commission grant Montana-Dakota Utilities Co.'s request for approval of the Revised Conservation Program Tracking Mechanism Rate 90 Tariff effective February 1, 2013?

Telecommunications

1.     In the Matter of the Failure of Certain Telecommunications Companies to Timely Pay their Gross Receipts Tax (Finance Manager: Cindy Kemnitz)

On January 22, 2013, staff filed a letter with the Commission requesting withdrawal of the Order to Show Cause for Univance Telecommunications, Inc.

     TODAY, how shall the Commission proceed?

2.     TC12-184     In the Matter of the Application of Common Point LLC for a Certificate of Authority to Provide Local Exchange Services in South Dakota (Staff Analyst: Dave Jacobson, Staff Attorney: Kristen Edwards)

On October 31, 2012, the Commission received an Application for Approval of a Certificate of Authority of Common Point LLC (Common Point) to provide Tandem Access and Switched Access Local Exchange Telecommunications Services in South Dakota. The applicant states it will not provide dial tone to end user customers. On November 16, 2012, SDTA and SDN filed a Petition to Intervene with the Commission. On December 4, 2012, the Commission granted Intervention to SDTA and SDN. On January 15, 2013, the Commission received a Joint Stipulation of the Parties resolving all issues. On January 22, 2013, the Commission received a response to staff's data request 1.

     TODAY, shall the Commission grant the Certificate of Authority to Common Point LLC?

3.     TC12-193     In the Matter of the Approval of the ICC VoIP Amendment to an Interconnection Agreement between Qwest Corporation dba CenturyLink QC and McLeodUSA Telecommunications Services, LLC dba PAETEC Business Services (Staff Attorney: Karen Cremer)

On December 26, 2012, the Commission received a filing pursuant to 47 U.S.C. § 252 for approval of an ICC VoIP Amendment to the Interconnection Agreement between Qwest Corporation dba CenturyLink QC and McLeodUSA Telecommunications Services, LLC dba PAETEC Business Services for the State of South Dakota.

     TODAY, shall the Commission approve the amendment to the interconnection agreement?

4.     TC12-194     In the Matter of the Approval of the ICC VoIP Amendment to an Interconnection Agreement between Qwest Corporation dba CenturyLink QC and Windstream KDL, Inc. (Staff Attorney: Karen Cremer)

On December 26, 2012, the Commission received a filing pursuant to 47 U.S.C. § 252 for approval of an ICC VoIP Amendment to the Interconnection Agreement between Qwest Corporation dba CenturyLink QC and Windstream KDL, Inc. for the State of South Dakota.

     TODAY, shall the Commission approve the amendment to the interconnection agreement?

5.     TC13-001     In the Matter of the Application of Nexus Communications, Inc., for Designation as an Eligible Telecommunications Carrier (Staff Analyst: Patrick Steffensen, Staff Attorney: Kristen Edwards)

On January 4, 2013, the Commission received an application by Nexus Communications, Inc. requesting to be designated as a Lifeline-only eligible telecommunications carrier throughout non-rural wire centers pursuant to SDCL §49-31-78 and Section 214(e) of the Federal Communications Act of 1934, as amended, for the limited purpose of receiving federal support for the provision of prepaid wireless Lifeline service to eligible South Dakota residents. Nexus Communications, Inc. also requests a waiver of ARSD 20:10:32:43.02 as they are not seeking high-cost support. On January 23, 2013, the Commission received responses to staff data requests 1 and 2.

     TODAY, shall the Commission grant waiver of ARSD 20:10:32:43.02 and designate Nexus Communications, Inc. an ETC for the Designated Service Area for purposes of receiving federal Lifeline universal service support?

Announcements

  1. The PUC will host an open house for legislators on Wednesday, January 30, 2013, from 7:30 to11:00 a.m. CST in the Commission Office, First Floor at the State Capitol Building, Pierre, S.D.

  2. The next regularly scheduled commission meeting will be Tuesday, February 12, 2013, at 2:30 p.m. CST in Room 423 at the State Capitol Building, Pierre, S.D.

  3. The PUC offices will be closed Monday, February 18, 2013, in observance of Presidents' Day.

  4. Commission meetings are scheduled for February 26 and March 12, 2013.
