MINUTES OF AD HOC COMMISSION MEETING

         Commissioner Chris Nelson called the meeting to order. Present were Commission Attorney Adam de Hueck; Commission Advisor Greg Rislov; Staff Attorney Kristen Edwards; Staff Analyst Jon Thurber; and Administrative Staff Mikayla Frick.

         Also present were Ellie Bailey, Riter Rogers LLP, representing South Dakota Rural Electric Association and South Dakota Association of Rural Water Systems.

         Joining the meeting by telephone were Chairperson Kristie Fiegen and Commissioner Gary Hanson; Brian Jorde, Domina Law Group, representing landowner intervenors; William Taylor, Taylor Law Firm, representing United Association of Journeymen and Apprentices of the Plumbing and Pipe Fitting Industry of the United States and Canada; International Union of Operating Engineers Local 49; and Laborers International Union of North America ; Paul Lewis, Moody County State’s Attorney; Melanie Carpenter, Woods, Fuller, Shultz & Smith PC, representing Navigator CO2 Ventures LLC.

Hydrocarbon and Carbon Dioxide Pipeline

1.      HP22-002        In the Matter of the Application of Navigator Heartland Greenway, LLC for a Permit Under The South Dakota Energy Conversion and Transmission Facilities Act to Construct the Heartland Greenway Pipeline in South Dakota (Staff Analysts: Darren Kearney, Jon Thurber; Staff Attorney: Kristen Edwards)

         Commissioner Nelson moved to deny the Intervening Landowners’ Motion as it relates to remote or telephonic testimony and to grant the Intervening Landowners’ Motion as it relates to a time certain on July 27, 2023, to hear the testimony of Dr. John Abraham. Motion carried 3-0.

         Commissioner Fiegen moved to grant Laborers Union of North America’s and International Union of Operating Engineers Local 49’s Motion for Time Certain for the testimony of witnesses Nathaniel Runke and Randall Harris. Motion carried 3-0.

         There being no further business, at the hour of 1:24 p.m., the South Dakota Public Utilities Commission meeting adjourned.
