South Dakota Public Utilities Commission Meeting

MINUTES OF THE AD HOC COMMISSION MEETING
Chairperson Kristie Fiegen called the meeting to order. Present were: Commissioner: Chris Nelson; Commission Attorneys: Karen Cremer and Adam de Hueck; Commission Advisor: Greg Rislov; Staff Attorneys: Amanda Reiss and Kristen Edwards; Grain Warehouse Manager: Cody Chambliss; Grain Warehouse Inspector: Justin Blais; and Staff: Katlyn Gustafson.
Present were:
Cheri Whittler, court reporter; Bob Mercer, reporter; Ralph Marquardt, Lucille Marquardt, Doug Marquardt, John Marquardt, Utica Grain, Inc. dba Upper Midwest Grain Elevator; Dave Husby, Utica Grain, Inc. dba Upper Midwest Grain Elevator; Jason Pearson, Utica Grain, Inc. dba Upper Midwest Grain Elevator; Mitchell Peterson, Davenport, Evans, Hurwitz & Smith, L.L.P., representing Utica Grain, Inc. dba Upper Midwest Grain Elevator, and Mitch Richter, SD Farmers Union.
Joining the meeting by telephone were:
Commissioner: Gary Hanson; and Cherie Hoffman, Town of Utica.
Grain Warehouse
1. GW18-001 In the Matter of the Grain Buyer License of Utica Grain, Inc. dba Upper Midwest Grain Elevator (Grain Warehouse Manager: Cody Chambliss; Staff Attorneys: Amanda Reiss, Kristen Edwards)

Commissioner Nelson moved to defer the docket until the September 4th, 2018, Commission meeting, that Utica Grain shall immediately begin to follow the Plan it filed in this matter, that by August 31, 2018, Utica Grain shall file an accurate financial statement signed under oath by Ralph Marquardt, and that Staff shall respond to Utica Grain’s Plan and add any additional items as needed by August 31, 2018. Motion carried 3-0.
Public Comment
Chairperson Kristie Fiegen opened the floor to public comments. Those offering public comments about Utica Grain, Inc. dba Upper Midwest Grain Elevator included Mitch Richter, SD Farmers Union.
There being no further business, at the hour of 1:03 p.m., the South Dakota Public Utilities Commission meeting adjourned.
