MINUTES OF THE AD HOC COMMISSION MEETING

Chairperson Kristie Fiegen called the meeting to order. Present were: Commissioner: Chris Nelson Commission Attorneys: Karen Cremer and Adam de Hueck; Commission Advisor: Greg Rislov; Staff Attorneys: Amanda Reiss and Kristen Edwards; Staff Analyst: Darren Kearney, Jon Thurber, Jim Mehlhaff and Todd Knoll; and Staff: Katlyn Gustafson.

Present were:
Cheri Whittler, court reporter; Mollie Smith, Fredrikson & Byron, P.A., representing Crocker Wind Farm, LLC; Melissa Schmit and Betsy Engelking, Crocker Wind Farm, LLC; Brett Koenecke, May, Adam, Gerdes & Thompson LLP, representing Crocker Wind Farm, LLC; and Donette Dunlavy, Jean Stevens, Linda Jansen, Grace Adam, Darci Adam, Nancy Talbot, Dustin Van Gilder, Dave Adam and Joseph Jansen, intervenors.

Joining the meeting by telephone were:
Commissioner: Gary Hanson; Reece Almond, Davenport, Evans, Hurwitz & Smith LLP, representing intervenors; Kristi Mogen, self; and Teresa Kaaz, self.

1.     EL17-055     In the Matter of the Application by Crocker Wind Farm, LLC for a Permit of a Wind Energy Facility and a 345 kV Transmission Line in Clark County, South Dakota, for Crocker Wind Farm (Staff Analysts: Darren Kearney, Jon Thurber; Staff Attorneys: Kristen Edwards, Amanda Reiss)

     Commissioner Nelson moved to grant Crocker Wind Farm, LLC the requested permit for a wind energy facility and permit for a 345 kV Transmission Line with the conditions agreed to by Staff and Applicant and as modified by Staff’s letter on June 5, 2018.

     Commissioner Nelson then moved to amend the permit conditions to read as described in EL17-055 Crocker Wind Conditions Amendments Proposed by Commissioner Nelson accessible at: http://puc.sd.gov/commission/dockets/electric/2017/el17-055/nelsonamendments.pdf.
Motion carried 3-0.

     Commissioner Fiegen moved to amend condition number 37 to include the words, “an independent” and the words “and the Commission”. Motion carried 3-0.

     Commissioner Hanson moved to amend condition number 23 to strike “325” and insert “150”. Motion failed 1-2.

     Commissioner Hanson moved to include Staff’s public liaison condition in its entirety as written in Staff’s post hearing brief on page 14. Motion carried 3-0.

     Commissioner Hanson moved to include Staff’s environmental impacts condition in its entirety as written in Staff’s post hearing brief on page 15. Motion failed 1-2.

     Commissioner Nelson moved to amend condition number 35 to include the words, “shall be provided to Commission Staff and made available on the Commission website”. Motion carried 3-0.

     Commissioner Nelson’s motion to grant Crocker Wind Farm, LLC the requested permit for a wind energy facility and permit for a 345 kV Transmission Line with the conditions as amended. Motion carried 3-0.

There being no further business, at the hour of 11:33 a.m., the South Dakota Public Utilities Commission meeting adjourned.
