Hearing on Orders to Show Cause for Failure to Pay CY 2015 Gross Receipt Tax

MINUTES OF THE COMMISSION HEARING
Chairman Chris Nelson called the hearing to order at 8:45 a.m. CST. Present in Room 413 of the State Capitol Building in Pierre, the location noticed for public attendance and participation, were: Commissioners: Kristie Fiegen and Gary Hanson; Commission Attorneys: Karen Cremer and Adam de Hueck; Commission Advisor: Greg Rislov; Staff Attorneys: Kristen Edwards and Amanda Reiss; Finance Manager: Cindy Kemnitz and Administrative Assistants: Katlyn Gustafson and Joy Lashley.

TC16-064 In the Matter of the TTUSA Acquisition Inc.'s Failure to Timely Pay the Gross Receipts Tax
TC16-066 In the Matter of the Ztar Mobile Inc.'s Failure to Timely Pay the Gross Receipts Tax
Ms. Cindy Kemnitz, Finance Manager, testified that the companies listed in Exhibit 1 have been contacted due to their failure to pay gross receipts tax (GRT) for CY 2015.
Ms. Edwards moved to admit Exhibit 1. There being no objection, Exhibit 1 was admitted into the record. Ms. Kemnitz recommended that the Commission revoke Gold Line Telemanagement Inc. and Net One International Inc.’s Certificate of Authority and order TTUSA Acquisition Inc., Defense Mobile Corp, and Ztar Mobile Inc. to file the appropriate reports and pay the delinquent gross receipts tax that is due including a 10% penalty for each month of delinquency.
Commissioner Nelson moved that the Commission revoke the Certificate of Authority of Gold Line Telemanagement Inc. and Net One International Inc. for failure to pay the gross receipts tax, pursuant to SDCL 49-1A-3, 49-1A-5, and 49-31-3 and that TTUSA Acquisition Inc., Defense Mobile Corp, and Ztar Mobile Inc. file the appropriate reports and pay the delinquent gross receipts tax that is due including a 10% penalty for each month of delinquency. Motion passed 3-0.
There being no further business, at the hour of 8:50 a.m. the South Dakota Public Utilities Commission Hearing adjourned.
