MINUTES OF THE AD HOC COMMISSION MEETING

Hydrocarbon Pipeline

1.      HP14-002     In the Matter of the Application of Dakota Access, LLC for an Energy Facility Permit to Construct the Dakota Access Pipeline (Staff Analysts: Brian Rounds, Darren Kearney; Staff Attorneys: Kristen Edwards, Karen Cremer)

     Commissioner Hanson moved to grant the Motion to Allow Telephonic Testimony. Motion carried 3-0.

     Commissioner Nelson moved to grant the City of Sioux Falls’ motion to allow its witness to testify at a time certain on October 7, 2015. Motion carried 3-0.

     Commissioner Nelson moved to grant SDARWS’ request that its witness be allowed to testify at a time certain on October 7, 2015. Motion carried 3-0.

     Commissioner Nelson moved to grant Yankton Sioux Tribe’s motion to allow two of its witnesses to testify at a time certain on October 6, 2015. Motion carried 3-0.

     Commissioner Nelson moved to grant Glenn Boomsma’s request to allow the witnesses he is representing to testify at a time certain on October 6, 2015. Motion carried 3-0.

Pipeline Safety

1.      PS15-001     In the Matter of the Filing by Commission Pipeline Safety Staff for Approval of a Penalty for a Pipeline Safety Violation by Humboldt Municipal Gas Utilities (Pipeline Safety Inspectors: Mary Zanter, Boice Hillmer; Staff Attorney: Kristen Edwards)

     The Commission deferred action on this docket and directed the Humboldt Gas Board and Staff to work together to develop a staffing plan which the Humboldt Gas Board should propose before the next regular Commission meeting.

     Commissioner Hanson moved to grant SDARWS’ Motion for Substitution of Witness. Motion carried 3-0.
