Minutes of Ad Hoc Commission Meeting

Chairman Steve Kolbeck called the hearing to order.  Present were: Commission Counsel: Rolayne Wiest; Commission Advisor: Greg Rislov; Staff Attorney: Karen Cremer; Staff Analyst: Bobbi Bourk; and Staff: Demaris Axthelm.

Also present were: Rich Coit, South Dakota Telecommunications Association; Darla Pollman Rogers, Riter, Rogers, Wattier and Northrup, representing Midstate Telcom and RC Communications, Inc; Jeff Carmon, Qwest Corporation; William Van Camp, Olinger Lovald McCahren & Reimers PC, representing AT&T Communications of the Midwest, Inc.; and Midcontinent Communications representatives: Tom Simmons, Mary Lohnes and Dan Nelson.

Joining the meeting by telephone were: Commissioner Chris Nelson; Commissioner Gary Hanson; Nancy Vogel, Midcontinent Communications; Kathy Ford, Davenport, Evans, Hurwitz & Smith, LLP, representing Midcontinent Communications; Qwest Corporation representatives: Jason Topp and Lisa Hensley-Eckert; James Cremer, Bantz, Gosch, & Cremer, representing Northern Valley Communications, LLC; Meredith Moore, Cutler & Donahoe LLP, representing SSTELECOM, Inc.; and Talbot Wieczorek, Gunderson, Palmer Nelson & Ashmore, representing Sprint Communications Company, L.P.

Rule Making

1.     RM05-002     In the Matter of Revisions and/or Additions to the Commission's Switched Access Rules Codified in ARSD 20:10:27 through 20:10:29 (Staff Attorney: Karen Cremer)

Commissioner Nelson moved that the Commission adopt the rules as proposed except for the style and form changes as recommended by LRC and proposed rule 20:10:27:02.01 and that proposed rule 20:10:27:02.01 be changed to provide that a CLEC's intrastate switched access rates shall not exceed  the intrastate switched access rate of the Regional Bell Operating Company operating in the state.  Motion passed 3-0.

There being no further business, at the hour of 9:45 a.m. the South Dakota Public Utilities Commission Hearing adjourned.
