South Dakota Public Utilities Commission Meeting

MINUTES OF THE AD HOC COMMISSION MEETING

 

Commissioner Steve Kolbeck called the meeting to order.  Present were: Executive Director Patty Van Gerpen; Commission Advisor Greg Rislov; Commission Attorney Rolayne Wiest; Staff Attorney Kara Semmler; Staff Analyst Harlan Best, and Administrative Secretary Demaris Axthelm.

Also present were: Talbot Wieczorek, Gunderson, Palmer, Goodsell and Nelson, representing Alltel Communications, Inc; Ms. Darla Pollman Rogers, Riter, Roger, Wattier & Brown, representing Venture Communications Cooperative; Mr. Rich Coit, South Dakota Telecommunications Association; and Sean Simpson, Alltel Communications.

Joining the meeting by telephone were:  Chairman Dustin Johnson; Vice Chairman Gary Hanson; and Mary Sisak, Blooston, Mordkofsky, Dickens, Duffy & Pendergast, representing Venture Communications.

Telecommunications

TC06-181  -  In the Matter of the Petition of Venture Communications Cooperative for Suspension or Modification of Local Dialing Parity Reciprocal Compensation Obligations (Staff Analyst:  Harlan Best, Staff Attorney: Kara Semmler)

              Ms. Darla Pollman Rogers, representing Venture Communications, requested that the Commission grant the Joint Motion for Transfer.  No parties objected.

              Commissioner Kolbeck moved to grant the joint motion for transfer from OHE to the Commission in Docket TC06-181.  Motion passed 3-0.

              Ms. Rogers then requested that the Commission grant the Motion to Strike and Motion in Limine.  Ms. Rogers stated that Alltel had filed additional testimony that went beyond the limited exception for additional testimony that was allowed for in the Joint Motion for Transfer. Mr. Rich Coit, representing SDTA, supported the Motion to Strike and Motion in Limine.  Mr. Sean Simpson, representing Alltel Communications, stated that the additional testimony that was filed by Alltel witnesses was within the scope of the language allowing for additional testimony in the Joint Motion for Transfer.  He stated that the Motion to Strike and Motion in Limine should be denied.  Mr. Talbot Wieczorek, representing RCC and Alltel, agreed that the motions should be denied.  Ms. Kara Semmler, representing Staff, stated that Staff did not object to allowing the additional testimony into the record.  Ms. Rolayne Wiest, Commission Attorney, recommended granting the Motion to Strike and Motion in Limine.

              Commissioner Kolbeck moved to grant the motion to strike and grant the motion in limine in Docket TC06-181.  Motion passed 3-0.

Commissioner Kolbeck moved to set the hearing for October 3 and 4, 2007, beginning at 8:00 A.M. on October 3.  Venture shall file any responsive testimony on or before September 25, 2007.  Motion passed 3-0.
