MINUTES OF THE AD HOC MEETING


Chairman Bob Sahr called the meeting to order. Also present were Commissioner Jim Burg; Executive Director Pamela Bonrud; Deputy Executive Director Heather Forney; Commission Advisor Greg Rislov; Commission Attorney Rolayne Ailts Wiest; Staff Attorney Karen Cremer; Staff Analysts Harlan Best; Court Reporter Cheri Wittler.

Also present were Rich Coit, South Dakota Telecommunications Association; Darla Rogers, Riter, Rogers, Mayer, Hofer, Wattier & Brown, representing South Dakota Telecommunications Association, Golden West Telecommunications Coop, Vivian Telephone Company, Venture Communications Cooperative, Tri-County Telecom, Inc., West River Cooperative Telephone Co.; and Randy Houdek, Venture Communications Cooperative.

Joining the meeting by telephone were Vice Chairman Gary Hanson; Ben Dickens, Blooston, Mordkoffky, Jackson, Dickens; Talbot Wieczorek - Gunderson, Paul, Goodsell & Nelson; James Blundell, Gene DeJordy, and Mark Ayotte, Western Wireless; Jim Cremer, James Valley Telephone; and Talbot Wieczorek, Gunderson, Paul, Goodsell and Nelson representing Western Wireless.

Telecommunications

1. TC03-191 In the Matter of the Filing by WWC License, LLC d/b/a CellularOne for Designation as an Eligible Telecommunications Carrier in Other Rural Areas. (Staff Analyst: Harlan Best, Staff Attorney: Karen Cremer)

Chairman Sahr moved to grant the Intervenors' Motion to Expand Procedural Schedule to allow additional discovery. The procedural schedule will be amended as follows:

March 16, 2004 Intervenors shall file reply testimony;
March 17, 2004 Intervenors will serve further discovery on WWC License, LLC;
March 31, 2004 WWC License, LLC may file responses to discovery;
April 5, 2004 WWC License, LLC may file re al testimony;
April 16, 2004 Intervenors may file surreal testimony;
April 23, 2004 WWC License, LLC may file a response to Intervenors' surreal testimony; and,
May 4, 5, and 6, 2004 Hearing.

Commissioner Burg seconded and Commissioner Hanson concurred. Motion passed 3-0.

Chairman Sahr moved to defer action on the Intervenors' Motion to Compel Discovery in TC03-191.

Meeting adjourned.
