MINUTES OF THE COMMISSION MEETING

Chairman Jim Burg called the meeting to order. Chairman Burg moved to approve the minutes of the August 16, 2001, meeting. Commissioner Nelson seconded. Motion passed 2-0.

Consumer Issues

1. Status Report On Consumer Utility Inquiries And Complaints Recently Received By The Commission. (Consumer Affairs: Mary Healy.)

Ms. Mary Healy presented an update on inquiries and complaints received since the last Commission meeting.

2. TC98-176 IN THE MATTER OF THE COMPLAINT FILED BY RANDY KIEFFER, STURGIS, SOUTH DAKOTA, AGAINST U S WEST COMMUNICATIONS, INC. REGARDING TELEPHONE SERVICE OUTAGES AND INADEQUATE SERVICE. (Staff Analyst: Leni Healy. Staff Attorney: Karen Cremer.)

The Commission received an update concerning the complainant's current service. Randy Kieffer, Complainant, explained the problems with Quest. Commissioner Nelson requested copies of trouble reports from US WEST Communications, Inc. Colleen Sevold, representing Qwest (fka US WEST), reported that the problem was being worked on continually because of weather-related problems.

CT99-002 IN THE MATTER OF THE COMPLAINT FILED BY RANDY KIEFFER, STURGIS, SOUTH DAKOTA, AGAINST U S WEST COMMUNICATIONS, INC. REGARDING SERVICE PROBLEMS. (Staff Analyst: Leni Healy. Staff Attorney: Karen Cremer.)

Mr. Kieffer indicated that he wanted a hearing. A hearing will be scheduled to update the record. No formal action was taken.

3. CE01-001 IN THE MATTER OF THE COMPLAINT FILED BY REX AND LORI CALDWELL, SPEARFISH, SOUTH DAKOTA, AGAINST BLACK HILLS POWER AND LIGHT REGARDING THE UNAUTHORIZED USE OF THEIR PROPERTY. (Staff Analyst: Mary Healy. Staff Attorney: Karen Cremer.)

Chairman Burg stated that due to the Caldwell's objections, the admission of the affidavit filed after the hearing by Tom Berry, should not be allowed. He further stated that, with respect to the merits of the complaint, Black Hills' tariff, which has been approved by the Commission, contains conditions of service which are applicable both to Black Hills and to its customers. Pursuant to that tariff, a customer is required to procure satisfactory right-of- way and easements for Black Hills' lines which are necessary for the furnishing of service to the customer. Such right-of-way is required to be provided without charge. Further, each Black Hills' customer is required to provide all trenching for underground line extensions. In addition, once Black Hills provides a line extension to the customer, the tariff provides that the company reserves the right at all times to add customers to that extension. Thus, given these tariff provisions, the Complainants may not obtain the relief they have requested.

Chairman Burg moved that the Commission not allow the admission of the affidavit filed after the hearing by Tom Berry. Chairman Burg further moved to deny the relief requested by the Complainants. Commissioner Nelson seconded. Motion passed 2-0.

4. CT01-031 IN THE MATTER OF THE COMPLAINT FILED BY S&S COMMUNICATIONS AND LES SUMPTION, ABERDEEN, SOUTH DAKOTA, AGAINST MCI WORLDCOM REGARDING UNAUTHORIZED BILLING FOR SERVICES. (Staff Analyst: Heather Forney. Staff Attorney: Karen Cremer.)

6. CT01-035 IN THE MATTER OF THE COMPLAINT FILED BY JOAN M. HORSTMAN, SIOUX FALLS, SOUTH DAKOTA, AGAINST TOUCH AMERICA, INC. AND SPRINT COMMUNICATIONS COMPANY L.P. REGARDING UNAUTHORIZED SWITCHING OF SERVICES AND BILLING FOR SERVICES. (Staff Analyst: Mary Healy. Staff Attorney: Karen Cremer.)

Tom Harmon, representing Sprint, explained the motion to dismiss it as a party.

Chairman Burg moved to grant Sprint's motion to dismiss. Commissioner Nelson seconded. Motion passed 2-0.

7. CT01-037 IN THE MATTER OF THE COMPLAINT FILED BY GERALD LARSON, BERESFORD, SOUTH DAKOTA, AGAINST BERESFORD MUNICIPAL TELEPHONE COMPANY, AT&T COMMUNICATIONS OF THE MIDWEST, INC. AND T-NETIX TELECOMMUNICATIONS SERVICES, INC. REGARDING UNAUTHORIZED COLLECT CALL CHARGES. (Staff Analyst: Charlene Lund. Staff Attorney: Karen Cremer.)

Commissioner Nelson moved to dismiss AT&T as a party to the docket and she further moved to deny dismissal of Beresford Municipal Telephone Company as a party to this docket. Chairman Burg seconded. Motion passed 2-0.

Telecommunications

1. TC98-146 IN THE MATTER OF THE FILING BY GCC LICENSE CORPORATION FOR DESIGNATION AS AN ELIGIBLE TELECOMMUNICATIONS CARRIER. (Staff Analyst: Harlan Best. Staff Attorney: Karen Cremer.)

Commissioner Nelson moved that the Commission find that it is in the public interest to designate GCC as an Eligible Telecommunications Carrier in the study areas of the rural telephone companies as listed in the stipulation, subject to the following conditions:


1) GCC shall file with the Commission its service agreement it intends to offer to universal service customers;


2) The service agreement will be consistent with the Commission's service quality rules;


3) The service agreement will state that any disputes or claims arising under the service agreement may be subject to the Commission's jurisdiction;


4) GCC will file its plan for advertising its universal service offering throughout service area and a list of its local calling service areas;


5) GCC's service agreement will state that a customer may qualify for financial assistance under the federal Link-Up and Lifeline programs and shall provide basic information on how to apply; and


6) GCC shall notify the Commission when it begins to offer its universal service package and in what study areas.


Chairman Burg seconded. Motion passed 2-0.

2. TC00-143 IN THE MATTER OF THE FILING FOR APPROVAL OF A RESALE AGREEMENT BETWEEN QWEST CORPORATION AND CONTINENTAL F.S. COMMUNICATIONS. (Staff Attorney: Karen Cremer.)

Chairman Burg moved to deny the resale agreement. Commissioner Nelson seconded. Motion passed 2-0.

3. TC00-193 IN THE MATTER OF THE FILING FOR APPROVAL OF A RESALE AGREEMENT BETWEEN QWEST CORPORATION AND NEW ACCESS COMMUNICATIONS, LLC. (Staff Attorney: Kelly Frazier.)

Mr. Frazier recommended that the resale agreement be approved.

Chairman Burg moved to approve the resale agreement. Commissioner Nelson seconded. Motion passed 2-0.

4. TC01-019 IN THE MATTER OF THE APPLICATION OF CONTINENTAL FIRST STAR COMMUNICATIONS COMPANY FOR A CERTIFICATE OF AUTHORITY TO PROVIDE LOCAL EXCHANGE SERVICES IN SOUTH DAKOTA. (Staff Analyst: Michele Farris. Staff Attorney: Karen Cremer.)

Ms. Farris recommended that Continental First Star Communications Company's application for a certificate of authority be denied.

Chairman Burg moved to deny Continental First Star Communications Company's application for a certificate of authority. Commissioner Nelson seconded. Motion passed 2- 0.

5. TC01-043 IN THE MATTER OF THE APPLICATION OF NOS COMMUNICATIONS, INC. FOR A CERTIFICATE OF AUTHORITY TO PROVIDE LOCAL EXCHANGE SERVICES IN SOUTH DAKOTA. (Staff Analyst: Heather Forney. Staff Attorney: Karen Cremer.)

Ms. Forney recommended that NOS Communications, Inc. (NOS) be granted a certificate of authority subject to rural safeguards.

Chairman Burg moved to grant a certificate of authority to NOS Communications, Inc. subject to rural safeguards. Commissioner Nelson seconded. Motion passed 2-0.

6. TC01-065 IN THE MATTER OF THE APPLICATION OF INTERNATIONAL TELCOM LTD. FOR A CERTIFICATE OF AUTHORITY TO PROVIDE INTEREXCHANGE TELECOMMUNICATIONS SERVICES IN SOUTH DAKOTA. (Staff Analyst: Keith Senger. Staff Attorney: Kelly Frazier.)

Mr. Senger recommended that International Telcom LTD. be allowed to withdraw its application for a certificate of authority.

Chairman Burg moved to grant the withdrawal of the application and he further moved to close the docket. Commissioner Nelson seconded. Motion passed 2-0.

7. TC01-072 IN THE MATTER OF THE FILING FOR APPROVAL OF AN ADOPTION AGREEMENT BETWEEN QWEST CORPORATION AND NPCR, INC. D/B/A NEXTEL PARTNERS. (Staff Attorney: Kelly Frazier.)

Mr. Frazier recommended that the adoption agreement between NPCR, Inc. d/b/a Nextel Partners and Qwest Corporation f/k/a US WEST Communications, Inc. be approved.

Commissioner Nelson moved to approve the agreement. Chairman Burg seconded. Motion passed 2-0.

8. TC01-074 IN THE MATTER OF THE APPLICATION OF FRONTIER COMMUNICATIONS OF AMERICA, INC. FOR A CERTIFICATE OF AUTHORITY TO PROVIDE INTEREXCHANGE TELECOMMUNICATIONS SERVICES IN SOUTH DAKOTA. (Staff Analyst: Michele Farris. Staff Attorney: Kelly Frazier.)

Ms. Farris recommended that Frontier Communications of America, Inc. be granted a certificate of authority with restrictions from offering prepaid calling cards, accepting advance payments and customer deposits.

Commissioner Nelson moved to grant a certificate of authority to Frontier Communications of America, Inc. with restrictions as noted above. Chairman Burg seconded. Motion passed 2-0.

9. TC01-081 IN THE MATTER OF THE FILING FOR APPROVAL OF A RESALE AGREEMENT BETWEEN QWEST CORPORATION AND QUANTUMSHIFT, INC. (Staff Attorney: Kelly Frazier.)

Mr. Frazier recommended that the resale agreement be approved.
