South Dakota Public Utilities Commission Meeting

MINUTES OF THE AD HOC COMMISSION MEETING
Chairman Burg called the meeting to order. Present were Commissioner Pam Nelson; Executive Director Debra Elofson; Commission Advisor Greg Rislov; Commission Counsel Rolayne Ailts Wiest; Transportation/Warehouse Director Bob Knadle; Staff Attorneys Karen Cremer and Kelly Frazier; Utility Analysts Michele Farris, Heather Forney and Keith Senger; Consumer Affairs Mary Healy; Deputy Executive Director Sue Cichos; and Administrative Secretary Amy Kayser.
Also present was Lori Grode, court reporter.
Joining the meeting by telephone were Chris Downs, Transportation/Warehouse Inspector; Debra Sittig, Home Federal Savings Bank; Steve Domm and Richard Lauck, Marion Elevator; and Tim Jensen, McCook Feed and Fertilizer customer.
Grain Dealer/Grain Warehouse
Mr. Frazier stated that he had not yet received the affidavit from Home Federal Savings Bank. Ms. Sittig, representing Home Federal Savings Bank, stated that there was some mis- communication between herself and Mr. Frazier and that the affidavit would be sent to Mr. Frazier by the end of the week. Mr. Downs explained the soybean inventory shortage and responded to questions. Mr. Knadle recommended that Dakota Valley Grain LLC, in lieu of their request for $1,500, be allowed an adjustment of $908.08 due to the miscalculation of the quantity of soybeans. At the present time Dakota Valley Grain LLC has not paid the $1,500 which is in dispute. Therefore it is Staff's position that Dakota Valley Grain LLC has an amount due of $591.92 ($1,500 - 908.08) in regard to the disputed amount of $1,500. Ms. Wiest recommended that action be deferred on the Motions to Reopen for Further Evidence until the affidavit from Home Federal Savings Bank has been received and reviewed. Action was deferred on the motions. The Commission took under advisement the issue of the miscalculation of soybeans.
