Grain Dealer/Grain Warehouse

GD01-001 - In the Matter of the Grain Dealer's and Public Warehouse Licenses of Freeman Fertilizer Co., Inc. d/b/a McCook Feed & Fertilizer. (Division Director: Bob Knadle. Staff Attorney: Kelly Frazier.)

Ms. Wiest recommended that the Commission request receivership of the grain and bonds of the Freeman Fertilizer Co., Inc. d/b/a McCook Feed & Fertilizer. Mr. Knadle explained the stipulation of February 13, 2001, when Freeman Fertilizer voluntarily relinquished its grain warehouse and grain dealer licenses and the Commission took possession of the grain stored in the facility. The grain in the elevator has been secured and inventoried. Ms. Sittig, representing Home Federal, noted that the bank has a superior position on the facilities and stored grain.

Chairman Burg moved to petition the circuit court for receivership of the grain and the bonds of the Freeman Fertilizer Co., Inc. d/b/a McCook Feed & Fertilizer. Commissioner Nelson seconded. Motion passed 2-0.

Meeting adjourned.
