South Dakota Public Utilities Commission Meeting

MINUTES OF THE AD HOC COMMISSION MEETING
Chairman Burg called the meeting to order. Present were Commissioner Pam Nelson; Executive Director Bill Bullard; Commission Advisor Greg Rislov; Commission Counsel Rolayne Ailts Wiest; Transportation/Warehouse Director Bob Knadle; Utility Analyst Keith Senger; and Administrative Secretary Mary Giddings.
Also present were Tom Jass, Farmers National Co.; Pat Kappenman; and Derald Klueber.
Joining the meeting by telephone were Debra Sittig, Wood, Fuller, Shultz & Smith representing Home Federal; Lance Nixon, Argus Leader; Bill Abell, Farmers National Co.; Ray Marquardt and Ralph Marquardt, R & R Ag Input; Mike Fink and Al Scott, Bjorkman & Fink Law Firm; Tim Jensen, Bob Helmbrecht, Jim McGregor, Dale Seubert, Richard Hoffman and Gilbert Buehner.
Grain Dealer/Grain Warehouse
Ms. Wiest recommended that the Commission request receivership of the grain and bonds of the Freeman Fertilizer Co., Inc. d/b/a McCook Feed & Fertilizer. Mr. Knadle explained the stipulation of February 13, 2001, when Freeman Fertilizer voluntarily relinquished its grain warehouse and grain dealer licenses and the Commission took possession of the grain stored in the facility. The grain in the elevator has been secured and inventoried. Ms. Sittig, representing Home Federal, noted that the bank has a superior position on the facilities and stored grain.
Chairman Burg moved to petition the circuit court for receivership of the grain and the bonds of the Freeman Fertilizer Co., Inc. d/b/a McCook Feed & Fertilizer. Commissioner Nelson seconded. Motion passed 2-0.
