South Dakota Public Utilities Commission Meeting

MINUTES OF THE AD HOC MEETING
Chairman Jim Burg called the meeting to order. Present were Commissioner Pam Nelson, Commissioner Laska Schoenfelder, Executive Director Bill Bullard, Deputy Director Sue Cichos, General Counsel Rolayne Ailts Wiest, Commission Advisor Greg Rislov, Staff Attorneys Karen Cremer and Camron Hoseck, Telecommunications Analyst Harlan Best, Utility Analysts Bob Knadle, Dave Jacobson and Michele Farris, Consumer Representative Leni Healy, and Administrative Secretary Shirleen Fugitt.
Also present were Joe Kafka, Associated Press, and Lori Grode, Pierre Court Reporting.
Joining the meeting by phone were Colleen Sevold, U S WEST; Tom Forte, Centurytel Long Distance/Glyphics Communications; and Michele Singer, AT&T.
Consumer Issues
Mr. Kieffer was unable to appear but faxed a written presentation to the Commission. Mr. Hoseck explained the complaint and recommended finding probable cause. Colleen Sevold, U S WEST, requested that this complaint be combined with TC98-176, Mr. Kieffer's original complaint.
Chairman Burg moved to find probable cause and to combine TC98-176 and CT99-002. Commissioner Schoenfelder seconded and Commissioner Nelson concurred. Motion passed 3-0.
Telecommunications
Ms. Farris explained the application and recommended approval with restrictions on deposits, advance payments and prepaid calling cards.
Commissioner Nelson moved to approve the application with restrictions on deposits, advance payments and prepaid calling cards. Commissioner Schoenfelder seconded and Chairman Burg concurred. Motion passed 3-0.
Ms. Farris explained the application and recommended approval pending receipt of a $25,000 bond from the company. Tom Forte, representing CenturyTel Long Distance, requested that the amount of the bond be lowered to $5,000. Ms. Cremer noted that Staff does not object to a lower bond.
Chairman Burg moved to approve the application contingent upon receipt of a $5,000 bond. Motion died for lack of a second.
Commissioner Nelson moved to approve the application contingent upon receipt of a $25,000 bond. Commissioner Schoenfelder seconded and Chairman Burg concurred. Motion passed 3-0.

Addendum
Telecommunications
1. IN THE MATTER OF THE ESTABLISHMENT OF REVISED TELECOMMUNICATIONS RULES. (General Counsel: Rolayne Wiest.)
Ms. Wiest suggested that a hearing for proposed slamming and cramming rules can be held May 13, 1999, at 1:30 p.m., with a May 24, 1999, deadline for filing comments.
Commissioner Schoenfelder moved to open a rule making docket to revise its telecommunications rules. Chairman Burg seconded and Commissioner Nelson concurred. Motion passed 3-0.
The meeting was adjourned.
