MINUTES OF THE COMMISSION MEETING

Chairman Jim Burg called the meeting to order. Present were Commissioner Pam Nelson, Commissioner Laska Schoenfelder, Executive Director Bill Bullard, Deputy Director Sue Cichos, Commission Advisor Greg Rislov, General Counsel Rolayne Ailts Wiest, Staff Attorneys Karen Cremer and Camron Hoseck, Telecommunications Analyst Harlan Best, Utility Analysts Bob Knadle, Dave Jacobson, Kylie Tracy, Michele Farris and Keith Senger, Consumer Representative Leni Healy and Administrative Secretary Shirleen Fugitt.

Also present were Colleen Sevold, U S WEST Communications; and Jennifer Stalley, South Dakota Rural Electric Association.

Joining the meeting by phone was Todd Lundy, U S WEST Communications.

Administration

1. Approval Of The Minutes Of The Commission Meetings Held On January 6, and January 11, 1999. (Staff: Shirleen Fugitt.)

Commissioner Nelson moved to approve the minutes of January 6 and January 11, 1999. Commissioner Schoenfelder seconded and Chairman Burg concurred. Motion passed 3-0.

Consumer Issues

1. Status Report On Consumer Utility Inquiries And Complaints Recently Received By The Commission. (Consumer Affairs: Leni Healy.)


Ms. Healy presented an update on consumer inquiries and complaints received since the last Commission meeting.

2. TC98-137 IN THE MATTER OF THE COMPLAINT FILED BY BRENT AND DAWN BARTON, MINA, SOUTH DAKOTA, AGAINST U S WEST COMMUNICATIONS, INC. REGARDING UPDATING LINES. (Consumer Representative: Leni Healy. Staff Attorney: Karen Cremer.)

Ms. Healy reported that the complainants wish to have the complaint dismissed.

Chairman Burg moved to close the docket. Commissioner Nelson seconded and Commissioner Schoenfelder concurred. Motion passed 3-0.

Telecommunications

1. TC98-147 IN THE MATTER OF THE APPLICATION OF FIBERCOMM, L.C. FOR A CERTIFICATE OF AUTHORITY TO PROVIDE TELECOMMUNICATIONS SERVICES IN SOUTH DAKOTA. (Staff Analyst: Kylie Tracy. Staff Attorney: Camron Hoseck.)

Ms. Tracy requested deferral. Action was deferred.

2. TC98-177 IN THE MATTER OF THE APPLICATION OF PAETEC COMMUNICATIONS, INC., FOR A CERTIFICATE OF AUTHORITY TO PROVIDE TELECOMMUNICATIONS SERVICES IN SOUTH DAKOTA. (Staff Analyst: Kylie Tracy. Staff Attorney: Karen Cremer.)

Ms. Tracy explained the application and recommended approval with restrictions on prepaid calling cards, advance payments and deposits and a stipulation that new contracted rates and penalties must be presented to the Commission on a case by case basis if not included in the tariff.

Commissioner Schoenfelder moved to approve the application with the restrictions and additional criteria noted above. Chairman Burg seconded and Commissioner Nelson concurred. Motion passed 3-0.

3. TC98-190 IN THE MATTER OF THE APPLICATION OF ENHANCED COMMUNICATIONS NETWORK, INC. FOR A CERTIFICATE OF AUTHORITY TO PROVIDE INTRASTATE TELECOMMUNICATIONS SERVICES IN SOUTH DAKOTA. (Staff Analyst: Dave Jacobson. Staff Attorney: Karen Cremer.)

Mr. Jacobson explained the application and recommended approval with restrictions on advance payments, deposits and prepaid calling cards.

Chairman Burg moved to approve the application with restrictions on advance payments, deposits and prepaid calling cards. Commissioner Schoenfelder seconded and Commissioner Nelson concurred. Motion passed 3-0.

4. TC98-201 IN THE MATTER OF THE APPLICATION OF FIRSTWORLD COMMUNICATIONS, INC. FOR A CERTIFICATE OF AUTHORITY TO PROVIDE TELECOMMUNICATIONS SERVICES IN SOUTH DAKOTA. (Staff Analyst: Bob Knadle. Staff Attorney: Karen Cremer.)

Mr. Knadle explained the application and recommended approval.

Commissioner Schoenfelder moved to approve the application. Chairman Burg seconded and Commissioner Nelson concurred. Motion passed 3-0.

The meeting was adjourned.
