PUBLIC UTILITIES COMMISSION MEETING

MINUTES OF THE AD HOC MEETING


Chairman Burg called the meeting to order. Present were Commissioner Pam Nelson, Executive Director Bill Bullard, General Counsel Rolayne Ailts Wiest, Staff Attorney Camron Hoseck, Fixed Utilities Division Director Greg Rislov, Deputy Director Harlan Best, Utility Analysts Bob Knadle and Dave Jacobson, Engineer Martin Bettmann, Consumer Representative Leni Healy, Business Manager Sue Cichos and Administrative Secretary Shirleen Fugitt. Commissioner Laska Schoenfelder was absent.

Also present were Todd Chambers, Jerry Wattier and Bob Hofer, representing the City of Pierre; Alisa Demers, Capital Journal; Tom Maher representing a group of intervenors; Tony Mangen, KCCR; and Al Lundy, South Dakota Public Broadcasting.

1. EL98-004 IN THE MATTER OF THE PETITION FOR DECLARATORY RULING FILED BY THE CITY OF PIERRE REGARDING A TRANSMISSION LINE. (Staff Engineer: Martin Bettmann. Staff Attorney: Camron Hoseck.)

Following comments from both parties regarding motions filed on April 9, 1998, by attorney, Tom Maher, Ms. Wiest proposed that Mr. Maher submit a list of questions in writing on or before Wednesday, April 14, 1998; that Todd Chambers and Robert Thielen be available for depositions this week; and, that the City have engineers available at the April 22, 1998, hearing. Ms. Wiest recommended allowing Mr. Maher's motion for discovery but denying an extension of time.

Chairman Burg moved to allow discovery and deny an extension of time. Commissioner Nelson seconded. Commissioner Schoenfelder was absent and not voting. Motion passed 2-0.

The meeting was adjourned.
