AGENDA OF COMMISSION MEETING


Electric

1.      EL08-011         In the Matter of the Petition for Electrical Service by South Dakota Oilseed Processors, L.L.C. to have NorthWestern Energy Assigned as its Electric Provider in the Service Area of Dakota Energy Cooperative, Inc. (Staff Analyst: David Jacobson, Staff Attorney: Karen Cremer)

         Petition by South Dakota Oilseed Processors, L.L.C. ("Oilseed Processors") to have NorthWestern Energy assigned as its electric provider in the service territory of Dakota Energy Cooperative, Inc. Oilseed Processors states it is a new customer in a new location in Hand County, South Dakota that will have a contracted minimum demand in excess of 2,000 kilowatts and requests to be served electricity by NorthWestern Energy pursuant to SDCL49-34A-56. On May 14, 2008, Dakota Energy Cooperative, Inc. filed a Petition for Intervention.  The Commission granted Intervention to Dakota Energy at its May 20, 2008, meeting. On October 17, 2008, the parties filed a Confidentiality Agreement; Settlement Agreement and a Service Rights Exception Agreement requesting the Commission approve the Service Rights Agreement.

         TODAY, shall the Commission Approve the Joint Request for an Electric Service Rights Exception?
