NOTE:  Docket participants who wish to join this meeting by conference call should contact the Commission at 605-773-3201 by 5:00 p.m. CDT on Monday, June 2, 2025, to reserve a phone line. Lines are limited and assigned on a first come, first served basis, subject to possible reassignment to accommodate persons who must appear in a proceeding. Ultimately, if you wish to participate in docket discussion at the Commission Meeting and a line is not available, you may have to appear in person.

Telecommunications

1.      TC23-006        In the Matter of the Petition of Dish Wireless LLC dba Gen Mobile for Designation as an Eligible Telecommunications Carrier in the State of South Dakota for the Limited Purpose of Providing Lifeline Service to Qualifying Customers (Staff Analyst: Brittany Mehlhaff; Staff Attorney: Amanda Reiss)

         On March 29, 2023, Dish Wireless LLC dba Gen Mobile (Dish Wireless or Gen Mobile) filed a Petition for Designation as an Eligible Telecommunications Carrier (ETC) in the State of South Dakota. Gen Mobile is seeking statewide ETC designation for the limited purpose of providing Lifeline service to qualifying customers. On March 30, 2023, the South Dakota Telecommunications Association (SDTA) filed a Petition to Intervene. On April 17, 2023, the Commission issued an Order Granting Intervention to SDTA. On May 14, 2024, SDTA and Dish Wireless filed a Stipulation and Agreement in which Dish Wireless agrees to limit its ETC designation to only South Dakota CenturyLink wire centers and to not extend into any rural service areas served by an SDTA member company. On April 17, 2025, SDTA, Gen Mobile and staff filed a Joint Stipulation regarding a hearing on the matter.

        TODAY, shall the Commission approve the Joint Stipulation? AND shall the Commission grant Gen Mobile’s Petition for Designation as an Eligible Telecommunications Carrier for purposes of receiving federal Lifeline universal service support? OR how shall the Commission proceed?

2.      TC25-004        In the Matter of the Filing of Qwest Corporation dba CenturyLink QC for Approval of Revisions to Its Access Service Tariff (Staff Analyst: Patrick Steffensen; Staff Attorney: Jennie Fuerst)

        On May 15, 2025, the Commission received a filing by Qwest Corporation dba CenturyLink QC for approval of revisions to its Access Service Tariff. CenturyLink proposes to cease providing adjusted rates for shared use arrangements. Shared use, also called ratcheting, occurs when private line/business data services and switched access are provided over the same DS1, DS3, or SST transport facility. CenturyLink proposes all shared use arrangements be rated as Private Line, irrespective of the type of service carried on the individual channels. CenturyLink requests an effective date of June 15, 2025.

         TODAY, shall the Commission approve the requested tariff changes with an effective date of June 15, 2025?

All who offer public comments are requested to sign in at the commission meeting or let the commission know of their wish to speak when they call in to reserve a phone line. Time limits for comments may be determined at the discretion of the commission.

1.   The next regular commission meeting will be Tuesday, June 17, 2025, at 9:30 a.m. CDT in Room 413 at the State Capitol Building, Pierre, South Dakota.

2.   The PUC office will be closed Thursday, June 19, 2025, in observance of Juneteenth.

3.   Commissioners will attend the Mid-America Regulatory Conference Annual Meeting, June 21-25, 2025, at The Westin, Indianapolis, Indiana.

4.   Commission meetings are scheduled for July 1 and 15, 2025.
