NOTE:  Docket participants who wish to join this meeting by conference call should contact the Commission at 605-773-3201 by 5:00 p.m. CDT on Monday, June 3, 2024, to reserve a phone line. Ultimately, if you wish to participate in docket discussion at the Commission Meeting and a line is not available, you may have to appear in person.

Telecommunications

1.      TC24-011        In the Matter of the Application of Ubiquity South Dakota, LLC for Certificates of Authority to Provide Local Exchange and Interexchange Telecommunications Services in the State of South Dakota (Staff Analyst: Patrick Steffensen; Staff Attorney: Logan Schaefbauer)

           On April 26, 2024, the Commission received an application from Ubiquity South Dakota, LLC (Ubiquity) for Certificates of Authority to Provide Local Exchange and Interexchange Telecommunications Services in the State of South Dakota. In its application, Ubiquity seeks a Certificate to operate as a wholesale provider of competitive local and interexchange services throughout the state of South Dakota. Ubiquity does not seek to provide retail voice telecommunications services nor switched access services. On May 3, 2024, the Commission received Ubiquity’s filing fee. On May 6, 2024, the South Dakota Telecommunications Association (SDTA) filed a Petition to Intervene. On May 8, 2024, Ubiquity filed a separate Interexchange Carrier Application and a Notice of Availability of Application.

1.      EL10-016        In the Matter of the Application of Great River Energy and Northern States Power Company dba Xcel Energy for a Permit to Construct a 10.6 Mile, 345 kV Transmission Line (CapX2020) in Brookings County Near White, South Dakota (Staff Analysts: Darren Kearney, Jon Thurber; Staff Attorney: Logan Schaefbauer)

         On November 23, 2010, the Commission received an Application from Great River Energy and Northern States Power Company dba Xcel Energy (Applicant) for a Permit to Construct a 10.6 Mile, 345 kV Transmission Line (CapX2020) in Brookings County Near White, South Dakota. On June 8, 2011, Applicant and Commission Staff filed a Joint Motion for Approval of Settlement Stipulation. On June 17, 2011, the Commission issued an Order Granting Joint Motion for Approval of Settlement Stipulation and Granting Permit to Construct Facilities. On April 9, 2024, pursuant to SDCL 49-41B-27, the Commission received CapX2020’s Certification for the Brookings County – Lyon County and Helena – Hampton Second-Circuit Project. SDCL 49-41B-27 requires that if a utility commences construction, expansion, or improvement on a facility more than four years after a permit has been issued, the utility must certify to the Commission that the facility continues to meet the conditions upon which the permit was issued. CapX2020 proposes to construct 10.6 miles of the second 345 kV circuit in South Dakota along the original Brookings line and a new breaker at the Brookings County substation. Condition 29 of the Settlement Stipulation requires CapX2020 to provide staff with certain pre-construction information not less than 30 days prior to commencement of construction. CapX2020 filed a Request for an Exemption of Condition 29 of the Settlement Stipulation, requesting the Commission allow the pre-construction information to be provided to staff less than 30 days before construction. Condition 25 of the Settlement Stipulation states that the Commission may grant an exemption to a particular condition upon an affirmative written request which clearly states the reason for the requested exemption.

         TODAY, shall the Commission grant an exemption to Condition 29 of the Settlement Stipulation?

All who offer public comments are requested to sign in at the commission meeting or let the commission know of their wish to speak when they call in to reserve a phone line. Time limits for comments may be determined at the discretion of the commission.

1.   The next regular commission meeting will be Monday, June 17, 2024, at 1:30 p.m. CDT in Room 413 at the State Capitol Building, Pierre, South Dakota.

2.   The PUC office will be closed Wednesday, June 19, 2024, in observance of Juneteenth.

3.   Commission meetings are scheduled for July 2 and 19, 2024.
