NOTE:  Docket participants who wish to join this meeting by conference call should contact the Commission at 605-773-3201 by 5:00 p.m. CDT on Wednesday, April 10, 2024, to reserve a phone line. Lines are limited and assigned on a first come, first served basis, subject to possible reassignment to accommodate persons who must appear in a proceeding. Ultimately, if you wish to participate in docket discussion at the Commission Meeting and a line is not available, you may have to appear in person.

ADDENDUM TO THE
AGENDA OF COMMISSION MEETING

Grain Warehouse

1.      GW24-001      In the Matter of PUC Staff’s Complaint Against Yield10 Bioscience, Inc. of Woburn, MA (Grain Warehouse Manager: Cody Chambliss; Staff Attorneys: Amanda Reiss, Logan Schaefbauer)

         On April 4, 2024, Commission staff submitted a Complaint against Yield10 Bioscience, Inc. of Woburn, MA (Yield10). In the Complaint, staff alleges Yield10 has failed to notify the Commission of its non-compliance with the financial standards required by South Dakota law in violation of SDCL 49-45-25, and that Yield10 has withheld requested materials from inspectors in violation of SDCL 49-45-26. In the Complaint, staff requests the Commission immediately suspend the grain buyer license of Yield 10 pursuant to SDCL 49-45-16(4) and issue civil penalties.

         TODAY, shall the Commission suspend Yield10’s grain buyer license?

Announcements, updated

1.   Commissioners and staff will hold a regional transmission discussion on Thursday, April 11, 2024, at 2:30 p.m. CDT in the Commission’s Conference Room in the State Capitol Building, Pierre, South Dakota.

2.   The next regular commission meeting will be Tuesday, April 23, 2024, at 9:30 a.m. CDT in Room 413 at the State Capitol Building, Pierre, South Dakota.

3.   Commission meetings are scheduled for May 8 and 21, 2024.
