Electric

1.     EL16-037     In the Matter of Commission Staff’s Request to Investigate Northern States Power Company dba Xcel Energy’s Proposed Fuel Clause Rider (Staff Analysts: Jon Thurber, Brittany Mehlhaff; Staff Attorney: Kristen Edwards)

On November 30, 2016, Northern States Power Company dba Xcel Energy (NSP) filed its monthly fuel clause rider (FCR), to be effective December 1, 2016. On November 30, 2016, Staff filed a Petition to suspend the rider for 180 days to allow adequate time for Staff to evaluate whether certain Purchase Power Agreements requested for cost recovery through the FCR are reasonable and cost effective.
 
     TODAY, shall the Commission give the Executive Director authority to enter into a consulting contract not to exceed $50,000?

2.     EL17-016     In the Matter of the Filing by NorthWestern Corporation dba NorthWestern Energy’s for Approval of its 2017 Economic Development Plan and 2016 Economic Development Report (Staff Analyst: Lorena Reichert; Staff Attorney: Kristen Edwards)

On March 31, 2017, the Commission received an application from NorthWestern Corporation dba NorthWestern Energy (NorthWestern) requesting approval of its 2017 Economic Development Proposed Budget and 2016 Economic Development Report. On April 21, 2017, Northwestern submitted revised Attachments A and B.

     TODAY, shall the Commission approve NorthWestern’s 2017 Economic Development Plan and 2016 Economic Development Report?

1.     NG17-005      In the Matter of the Filing by NorthWestern Corporation dba NorthWestern Energy for Approval of its 2017 Economic Development Plan and 2016 Economic Development Report (Staff Analyst: Lorena Reichert; Staff Attorney: Kristen Edwards)

On March 31, 2017, the Commission received an application from NorthWestern Corporation dba NorthWestern Energy (NorthWestern) requesting approval of its 2017 Economic Development Proposed Budget and 2016 Economic Development Report. On April 21, 2017, Northwestern submitted revised Attachments A and B.

     TODAY, shall the Commission approve NorthWestern’s 2017 Economic Development Budget and 2016 Economic Development Report?

Telecommunications

1.     TC13-106     In the Matter of the Application of i-wireless LLC for Designation as an Eligible Telecommunications Carrier (Staff Analyst: Darren Kearney; Staff Attorney: Karen Cremer)

On August 15, 2013, the Commission received a Petition for Designation as an Eligible Telecommunications Carrier in the State of South Dakota from i-wireless LLC (i-wireless). i-wireless seeks ETC designation solely to provide Lifeline service to qualifying South Dakota households; it will not seek access to funds from the federal Universal Service Fund for the purpose of participating in the Link-Up program or providing service to high cost areas. On April 27, 2017, i-wireless filed a letter requesting to withdraw, without prejudice, its Petition for Designation as an Eligible Telecommunications Carrier.

     TODAY, shall the Commission grant i-wireless’ request to withdraw, without prejudice, its Petition for Designation as an Eligible Telecommunications Carrier and close the docket?

2.     TC17-012     In the Matter of the Application of MAGICJACK SMB, INC. for a Certificate of Authority to Provide Local Exchange and Interexchange Long Distance Services in South Dakota (Staff Analyst: Patrick Steffensen; Staff Attorney: Amanda Reiss)

On April 6, 2017, the Commission received a filing from MAGICJACK SMB, INC. (MAGICJACK SMB) for a Certificate of Authority to provide local exchange and interexchange long distance services in South Dakota to business customers by using interconnected Voice over Internet Protocol. MAGICJACK SMB intends to provide local exchange services in the non-rural (CenturyLink) service territory. On April 25, and April 28, 2017, MAGICJACK SMB responded to Staff’s data requests.

     TODAY, shall the Commission grant MAGICJACK SMB, INC.’s request for a Certificate of Authority to Provide Local Exchange and Interexchange Long Distance Services in South Dakota?

3.     TC17-013     In the Matter of the Application of Broadsmart Global, Inc. for a Certificate of Authority to Provide Local Exchange and Interexchange Long Distance Services in South Dakota (Staff Analyst: Eric Paulson; Staff Attorney: Amanda Reiss)

On April 10, 2017, the Commission received a filing from Broadsmart Global, Inc. (Broadsmart) for a Certificate of Authority to provide local exchange and interexchange long distance services in South Dakota to business customers by using interconnected Voice over Internet Protocol. Broadsmart intends to provide local exchange services in the non-rural (CenturyLink) service territory. On April 25, 27, and May 2, 2017, Broadsmart responded to Staff’s data request.

     TODAY, shall the Commission grant Broadsmart Global, Inc.’s request for a Certificate of Authority to Provide Local Exchange and Interexchange Long Distance Services in South Dakota?

4.     TC17-014     In the Matter of the Approval of an Carrier Partner for Interconnected VoIP Provider Amendment to an Interconnection Agreement between Qwest Corporation dba CenturyLink QC and Neutral Tandem-South Dakota, LLC (Staff Analyst: Lorena Reichert; Staff Attorney: Kristen Edwards)

On April 12, 2017, the Commission received a filing pursuant to 47 U.S.C. § 252 for approval of an Amendment to an Interconnection Agreement between Qwest Corporation dba CenturyLink QC and Neutral Tandem-South Dakota, LLC.

     TODAY, shall the Commission approve the Amendment to the Interconnection Agreement?

5.     TC17-015     In the Matter of the Petition of Budget PrePay, Inc. dba Budget Mobile to Relinquish Its Designation as an Eligible Telecommunications Carrier(Staff Analyst: Eric Paulson; Staff Attorney: Kristen Edwards)

On April 21, 2017, Budget PrePay, Inc. dba Budget Mobile (Budget) filed a Petition for relinquishment of its Eligible Telecommunications Carrier Designation throughout its entire South Dakota designated ETC area effective June 5, 2017. Budget has amended the application through response to Staff data request on April 28, 2017, to request an effective date for the relinquishment of June 9, 2017.

     TODAY, shall the Commission Grant the Petition for Relinquishment of Eligible Telecommunications Carrier Designation?

  1. Commissioners and staff will meet with representatives of the South Dakota Rural Electric Association on Tuesday, May 9, 2017, at 1:30 p.m. CDT in Room 413 at the State Capitol Building, Pierre, S.D. The agenda is to discuss an industry update.

  2. The next regularly scheduled commission meeting will be Tuesday, May 23, 2017, at 9:30 a.m. CDT in Room 413 at the State Capitol Building, Pierre, S.D.

  3. The PUC office will be closed Monday, May 29, 2017, in observance of Memorial Day.

  4. Commission meetings are scheduled for June 6 and 16, 2017.
