1. TC03-108 In the Matter of the Establishment of Switched Access Rates for the Local Exchange Carriers Association. (Staff Analyst: Harlan Best, Staff Attorney: Karen Cremer)

On June 30, 2003, the Local Exchange Carriers Association (LECA) filed revised switched access tariff pages. The purpose of these revisions is to implement changes in rates as necessitated by revisions in member companies' revenue requirements and access minutes of use. At its September 16, 2003, meeting the Commission assessed a filing fee not to exceed $100,000. On June 2, 2004, the Commission issued an Order Approving Tariff Revisions, Subject to Refunds with Interest.

2. TC04-222 In the Matter of the Filing by DakotaComm, LLC for Approval of its Intrastate Switched Access Tariff and for an Exemption from Developing Company Specific Cost-Based Switched Access Rates. (Staff Analyst: Keith Senger, Staff Attorney: Karen Cremer)

On November 9, 2004, DakotaComm, LLC filed a petition for Commission approval to be exempt from developing company specific intrastate switched access rates. The petition states that DakotaComm is a new CLEC in South Dakota and it lacks the necessary financial, technical, and managerial resources needed to determine company-specific cost-based intrastate switched access rates. It has requested to opt into the Local Exchange Carriers Association rates filed with the Commission. The Commission granted the waiver at its December 14, 2004, meeting.

3. TC04-258 In the Matter of the Filing by Sancom, Inc. d/b/a Mitchell Telecom for Approval of its Intrastate Switched Access Tariff and for an Exemption from Developing Company Specific Cost-Based Switched Access Rates. (Staff Analyst: Harlan Best, Staff Attorney: Karen E. Cremer)

On December 2, 2004, Sancom, Inc. d/b/a Mitchell Telecom filed an Intrastate Switched Access tariff which "mirrors the rates, terms and conditions of the current LECA Tariff No. 1, with the exception of the switched access rates, which are based upon a statewide average in accordance with ARSD 20:10:27:12." Mitchell Telecom requests an effective date of January 1, 2005, for the tariff filing. The Commission granted the Waiver at its December 28, 2004, meeting.

On August 31, 2005, Midcontinent Communications (Midco) and MCI Metro Access Transmission Services, LLC (MCI) filed Petitions for Intervention. AT&T Communications of the Midwest, Inc. On October 20, 2006, Sprint Communications L.P. filed a petition seeking authorization to provide local exchange services in the rural area served by the City of Brookings Municipal Utilities - Telephone Division d/b/a Swiftel Communications ILEC in the Brookings rate center. On November 7, 2006, the South Dakota Telecommunications Association (SDTA) filed a Petition for Intervention.

On October 24, 2006, Sprint Communications L.P. filed a petition seeking authorization to provide local exchange services in the rural areas served by the Interstate Telecommunications Cooperative, Inc. ILEC in the Castlewood, Elkton, Estelline, Hayti, Lake Norden and White rate centers. On November 7, 2006, the South Dakota Telecommunications Association (SDTA) filed a Petition for Intervention. Interstate Telecommunications Cooperative (ITC) filed a Petition for Intervention on November 8, 2006.
