 AGENDA OF THE AD HOC COMMISSION MEETING

Rulemaking

1.     RM06-002    In the Matter of the Adoption of Rules Regarding Public Warehouses (Staff Attorney:  Rolayne Ailts Wiest)

The Commission opened this rulemaking docket to consider the adoption and amendment of rules regarding public grain warehouse storage.  One of the proposed changes would amend the construction requirements for temporary public grain storage units.  Another proposed rule allows for seasonal emergency storage which would allow a public grain warehouse to store grain outside between July 1 and January 31.  Another proposed rule allows for non-seasonal emergency storage which would allow a public grain warehouse to store grain outside between February 1 and June 30.  Commission approval will be needed for non-seasonal emergency storage.  For temporary, seasonal, and non-seasonal storage, a warehouse operator will be required to keep a separate record of the grain.  The proposed rules may be found on the Public Utilities Commission's home page at the following address:  http://puc.sd.gov  A public hearing was held on August 8, 2006, to consider the adoption and amendment of the proposed rules.
