1.    Status Report on Consumer Utility Inquiries and Complaints Received by the Commission.  (Consumer Affairs:  Deb Gregg)

 Electricity  

1.    EL05-027    In the Matter of the Filing by NorthWestern Corporation d/b/a NorthWestern Energy for Approval of Tariff Revisions.  (Staff Analyst:  Dave Jacobson, Staff Attorney:  Sara Greff)  

Application by NorthWestern Energy for approval of revisions to its Electric Tariff General Terms and Conditions, including the establishment of a tariffed line extension policy and associated cost recovery, establishment of policy for replacing overhead facilities with underground, changes to cogeneration and small power production interconnection, metering, continuity of service, and other changes. NorthWestern states it has been several years since these provisions have been updated and NorthWestern has utilized the tariff language of other companies and the tariffs of its Montana jurisdiction to develop these changes which will clarify its Electric Tariff.

TODAY, shall the Commission Approve the Tariff Revisions?  

2.     EL06-005      In the Matter of the Filing by Otter Tail Corporation d/b/a Otter Tail Power Company for Approval of Tariff Revisions.    (Staff Analyst:  Dave Jacobson and Nathan Solem, Staff Attorney:  Karen Cremer)  

Application by Otter Tail Power Company for approval of new rate codes for interruptible electric service which would separately apply to customers subject to service curtailment on 15 minute on / 15 minute off basis during summer months. This short duration cycling of curtailment is now possible because of a new load management system Otter Tail is currently installing.

Telecommunications

1.    TC05-060        In the Matter of the Filing by Midstate Telecom, Inc. for an Extension of an Exemption from Developing Company Specific Cost-Based Switched Access Rates.  (Staff Analyst:  Keith Senger, Staff Attorney:  Karen Cremer)

On April 24, 2001, the Commission granted Midstate Telecom, Inc (Midstate) a Certificate of Authority to provide local exchange services and granted Midstate a one year exemption from establishing company specific cost-based switched access rates. On April 2, 2002, Midstate filed for a three year exemption from filing cost-based switched access rates which was granted on May 16, 2002. On April 27, 2005, Midstate filed for a three year exemption from filing cost-based switched access rates and for approval of its intrastate switched access Tariff No. 1.

TODAY, shall the Commission to Approve Midstate Telecom, Inc.'s ARSD 20:10:27:11 Petition from Developing Company-Specific Cost-Based Switched Access Rates, AND, shall the Commission Grant Midstate and Staff's Joint Motion for a Waiver of ARSD 20:10:27:07 and 20:10:27:12, AND, shall the Commission Approve the Settlement Stipulation?

 2.         In the Matter of the Approval of the Amendments to Agreements in TC06-011, TC06-012, TC06-013, TC06-015, and TC06-016

TC06-011      In the Matter of the Filing for Approval of an Amendment to an Interconnection Agreement between Qwest Corporation and OrbitCom, Inc.  (Staff Attorney:  Sara Greff)

 On February 6, 2006 the Commission received a filing for the approval of a Qwest Digital Subscriber Line Amendment to the Interconnection Agreement between Qwest Corporation and OrbitCom, Inc.  According to the parties, this Amendment changes terms and conditions to the Qwest Digital Subscriber Line Agreement.  

 TC06-012      In the Matter of the Filing for Approval of an Amendment to an Interconnection Agreement between Qwest Corporation and New Edge Network, Inc. d/b/a New Edge Networks  (Staff Attorney:  Sara Greff)

 On February 6, 2006 the Commission received a filing for the approval of a Qwest Digital Subscriber Line Amendment to the Interconnection Agreement between Qwest Corporation and New Edge Network, Inc. d/b/a/ New Edge Networks.  According to the parties, this Amendment changes terms and conditions to the Qwest Digital Subscriber Line Agreement.

TC06-013      In the Matter of the Filing for Approval of an Amendment to an Interconnection Agreement between Qwest Corporation and New Edge Network, Inc. d/b/a New Edge Networks  (Staff Attorney:  Sara Greff)

  

On February 6, 2006 the Commission received a filing for the approval of a Triennial Review Order and Triennial Review Remand Order Amendment to the Interconnection Agreement between Qwest Corporation and New Edge Network, Inc. d/b/a/ New Edge Networks.  According to the parties, this Amendment changes or adds terms and conditions for certain UNEs. 

TC06-015      In the Matter of the Filing for Approval of an Amendment to an Interconnection Agreement between Qwest Corporation and FiberComm, L.C.   (Staff Attorney: Sara Greff)

On February 16, 2006, the Commission received a filing for the approval of an Expedite Requests Amendment to the Interconnection Agreement between Qwest Corporation and FiberComm, L.C.  According to the parties, this Amendment adds the terms, conditions and rates for the Expedite Requests Agreement. 

 TC06-016      In the Matter of the Filing for Approval of an Amendment to an Interconnection Agreement between Qwest Corporation and Northern Valley Communications, LLC.  (Staff Attorney:  Sara Greff)

On February 16, 2006, the Commission received a filing for the approval of a Single Point of Presence (SPOP) Amendment to the Interconnection Agreement between Qwest Corporation and Northern Valley Communications, LLC.  According to the parties, this Amendment adds terms and conditions for the Single Point of Presence. 

TODAY, shall the Commission Approve the Amendments to the Agreements?  

Announcements

 1.       The next regularly scheduled Commission meeting will be held April 11, 2006, at 9:30 a.m. in Room 412, at Pierre, South Dakota.

2.      Commission meetings are scheduled for April 11 and May 9, 2006.

3.     Staff and Commissioners will be attending the Qwest Regional Oversight Committee meetings in Scottsdale, AZ, March 28 – 29, 2006.
