Administration

1. Approval Of The Minutes Of The Commission Meeting Held On April 17, 2002. (Staff: Mary Giddings.)

Consumer Issues

1. Status Report On Consumer Utility Inquiries And Complaints Recently Received By The Commission. (Consumer Affairs: Mary Healy.)

The Commission has received 638 consumer contacts during 2002. 88 of the complaints were received since the April 17, 2002, meeting. So far the Commission has resolved 599 informal consumer complaints.

TELECOMMUNICATIONS: 72 of the contacts involved telecommunications. 17 contacts concerned billing issues; 6 concerned the unauthorized switch in telecommunication services; 3 concerned delayed service or delayed disconnect; 6 contacts involved telemarketers; 6 concerned unauthorized billing; 6 contacts involved increased rates; 2 involved poor service; 2 contacts involved fees; 8 involved cellular service and some of the remaining contacts involved deposits, Life Line/Link Up and provider identification codes.


ELECTRICITY: 12 of the contacts involved electricity issues. 5 of the contacts concerned disconnect; 3 concerned billing; 1 concerned being denied service; 1 concerned construction; 1 involved fees, and 1 contact cooperative dividends.


NATURAL GAS: 3 of the contacts involved natural gas. 1 of the contacts concerned billing and 2 contact involved disconnects.

Electric

1. EL02-006 IN THE MATTER OF THE FILING BY OTTER TAIL POWER COMPANY FOR APPROVAL OF A CONTRACT WITH DEVIATIONS WITH THE CITY OF NEW EFFINGTON. (Staff Analyst: Heather Forney. Staff Attorney: Kelly Frazier.)

On April 22, 2002, Otter Tail Power Company filed with the Commission a municipal contract with the City of New Effington effective May 1, 2002, and Otter Tail Power Company's summary List of Contracts with Deviations. The municipal contract for the City of New Effington was updated because the old contract will expire on May 1, 2002. The new contract does not include any new rates that would be considered a deviation.

TODAY, shall the Commission approve the proposed Contract with Deviations?

Natural Gas

1. NG01-012 IN THE MATTER OF THE FILING BY MIDAMERICAN ENERGY COMPANY FOR APPROVAL OF ITS 2001 ECONOMIC DEVELOPMENT REPORT AND ITS 2002 ECONOMIC DEVELOPMENT PLAN. (Staff Analyst: Heather Forney. Staff Attorney: Kelly Frazier.)

On December 28, 2001, the Commission received a filing from MidAmerican Energy Company pursuant to Docket NG95-019 requesting: (1) approval of its 2001 economic development report; and (2) approval of its 2002 economic development budget.

TODAY, shall the Commission approve the proposed 2001 Economic Development Report and 2002 Economic Development Plan?

2. NG02-002 IN THE MATTER OF THE FILING BY PEOPLES NATURAL GAS COMPANY FOR APPROVAL OF A TARIFF REVISION REFLECTING A NAME CHANGE. (Staff Analyst: Dave Jacobson. Staff Attorney: Karen Cremer.)

Application by Aquila, Inc. d/b/a Aquila Networks, formerly known as Peoples Natural Gas Company for approval of tariff revision reflecting change of name.

TODAY, shall the Commission approve the proposed tariff revision?

Telecommunications

1. TC00-196 IN THE MATTER OF THE APPLICATION OF Z-TEL COMMUNICATIONS, INC. FOR A CERTIFICATE OF AUTHORITY TO PROVIDE LOCAL EXCHANGE SERVICES IN SOUTH DAKOTA. (Staff Analyst: Michele Farris. Staff Attorney: Kelly Frazier.)

On April 22, 2002, the Commission received a filing from Z-Tel Communications (Z-Tel) whereby Z-Tel, to amend its certificate of authority, posted a $25,000 bond in order to receive Commission approval to provide prepaid services. Z-Tel requested that the Commission reinstate the company's ability to obtain advance payments from customers.

TODAY, shall the Commission accept the company's bond and reinstate the company's ability to obtain advance payments from customers?

2. TC01-143 IN THE MATTER OF THE APPLICATION OF SONIX4U, INC. FOR A CERTIFICATE OF AUTHORITY TO PROVIDE INTEREXCHANGE TELECOMMUNICATIONS SERVICES IN SOUTH DAKOTA. (Staff Analyst: Dave Jacobson. Staff Attorney: Kelly Frazier.)

Application by Sonix4U, Inc. for a Certificate of Authority to provide resold, non-facilities based, interexchange telecommunications service in South Dakota.

TODAY, shall the Commission grant a Certificate of Authority to Sonix4U, Inc.?

3. TC01-158 IN THE MATTER OF THE APPLICATION OF TELEGENIUS, INC. FOR A CERTIFICATE OF AUTHORITY TO PROVIDE INTEREXCHANGE TELECOMMUNICATIONS SERVICES IN SOUTH DAKOTA. (Staff Analyst: Michele Farris. Staff Attorney: Kelly Frazier.)

On October 10, 2001, Telegenius, Inc. filed an application for a Certificate of Authority to provide resold interexchange telecommunications services throughout South Dakota. The applicant proposes to acquire and resell various voice and data communications services offered by IXCs, and to package and provide these services for the specialized functions and needs of its customers. This matter was deferred at the April 17, 2002, meeting.

TODAY, shall the Commission grant a Certificate of Authority to Telegenius, Inc.?

4. TC02-027 IN THE MATTER OF THE FILING FOR APPROVAL OF TRANSFER OF CERTIFICATE OF AUTHORITY FROM WINSTAR WIRELESS, INC. TO WINSTAR COMMUNICATIONS, LLC. (Staff Analyst: Keith Senger. Staff Attorney: Kelly Frazier.)

On May 18, 1999, Winstar Wireless, Inc. received a Certificate of Authority to provide resold interexchange telecommunications services in South Dakota. On March 21, 2002, Winstar Wireless, Inc. and Winstar Communications, LLC. filed a joint application to transfer the Certificate of Authority of Winstar Wireless, Inc. to Winstar Communications, LLC.

TODAY, shall the Commission grant the proposed transfer of Certificate of Authority?

5. TC02-029 IN THE MATTER OF THE APPLICATION OF ACCXX COMMUNICATIONS, LLC FOR A CERTIFICATE OF AUTHORITY TO PROVIDE INTEREXCHANGE TELECOMMUNICATIONS SERVICES IN SOUTH DAKOTA. (Staff Analyst: Heather Forney. Staff Attorney: Karen Cremer.)

On March 27, 2002, Accxx Communications, LLC filed an application for a Certificate of Authority to provide interexchange telecommunications services in South Dakota. The Applicant is a reseller which intends to offer 1+ and 101XXXX outbound dialing, 800/888 Toll-Free inbound dialing, directory assistance, data services and travel card services.

TODAY, shall the Commission grant a Certificate of Authority to Accxx Communications, LLC?

6. TC02-032 IN THE MATTER OF THE APPLICATION OF MIDSTATE TELECOM, INC. FOR APPROVAL OF EXTENSION OF TIME OF EXEMPTION FROM DEVELOPING COMPANY SPECIFIC COST-BASED SWITCHED ACCESS RATES. (Staff Analyst: Keith Senger. Staff Attorney: Karen Cremer.)

On April 24, 2001, the Commission granted Midstate Telecom, Inc. (Midstate) a Certificate of Authority to provide local exchange services and granted Midstate a one-year exemption from establishing company specific cost-based switched access rates. On April 2, 2002, Midstate filed for a three-year exemption from filing cost-based switched access rates

Announcements

1. A hearing in EL02-003 (WREA) will be held on May 22, 2002, at 9:00am, in Room 412, of the State Capitol.

2. The next regularly scheduled Commission meeting will be held May 30, 2002, at 1:30pm, in Room 412 of the State Capitol Building.
