Consumer Issues

1. CT99-069 IN THE MATTER OF THE COMPLAINT FILED BY SANDY CURRAN, SISSETON, SOUTH DAKOTA, AGAINST OLS, INC. REGARDING SWITCHING TELECOMMUNICATIONS SERVICES THROUGH DECEPTIVE TACTICS. (Staff Analyst: Leni Healy. Staff Attorney: Karen Cremer.)

On December 8, 1999, the Commission received a complaint filed by Sandy Curran, Sisseton, South Dakota, against OLS, Inc. regarding switching telecommunications services through deceptive tactics. The Complainant indicates that as a result of a sales call, she switched her long distance service. The rates and fees which appeared on her billing were not the rates and fees promised. Probable cause was found in this matter at the December 28, 1999, regular meeting.

TODAY, if the matter is resolved shall the Commission dismiss the complaint and close the docket?

2. CT00-058 IN THE MATTER OF THE COMPLAINT FILED BY BRIAN LEROHL, FAIRVIEW, SOUTH DAKOTA, AGAINST BUSINESS OPTIONS, INC. AND HOLD BILLING SERVICES REGARDING UNAUTHORIZED SWITCHING OF SERVICES. (Staff Analyst: Charlene Lund. Staff Attorney: Camron Hoseck.)

Complainant reports that for the billing period ending February 13, 2000, his U S WEST bill contained charges of $76.48 from HOLD Billing Services and Business Options. He reports that he never agreed to those services, either verbally or in writing. He alleges that the switching of his long distance services constitutes fraud and the claim made by William Brzycki from Business Options that his services were verified on March 13, 1996 is false. The complainant requests compensation for his time to resolve the issue at $1152.00, plus travel time and expenses to come to Pierre at $300.00, for a total compensation of $1452. A hearing in this matter was scheduled for June 19, 2000. The hearing was cancelled.

Electric

1. EL00-006 IN THE MATTER OF THE APPLICATION OF MIDAMERICAN ENERGY COMPANY FOR DETERMINATIONS PURSUANT TO SECTION 32(K)(2)(A) OF THE PUBLIC UTILITY HOLDING COMPANY ACT. (Staff Analyst: Michele Farris. Staff Attorney: Camron Hoseck.)

Under Section 32(k)(1) of Public Utilities Holding Company Act, an electric utility may not enter into a contract to purchase electric energy at wholesale from an exempt wholesale generator if that exempt wholesale generator is an affiliate or associated company of the electric utility unless the Commission makes certain determinations as required by the Act. MidAmerican Energy Company seeks such a determination from the Commission with regard to its proposal to purchase power from Cordova Energy Center, an affiliate of MidAmerican.

Telecommunications

1. TC99-125 IN THE MATTER OF THE FILING FOR APPROVAL OF AN INTERCONNECTION AGREEMENT BETWEEN U S WEST COMMUNICATIONS, INC. AND PATHNET, INC. (Staff Attorney: Camron Hoseck.)

On December 29, 1999, the Commission received an interconnection agreement between Pathnet, Inc. and U S WEST Communications, Inc. for approval by the Commission. The agreement governs services for resale, certain unbundled network elements, ancillary functions and additional features to Pathnet, Inc. for the offering and provisioning of telecommunications services by Pathnet, Inc. The Agreement also sets forth the terms, conditions and prices under which the parties agree to interconnect and pay reciprocal compensation for the exchange of local traffic. Parties had until January 19, 2000, to file comments.

TODAY, shall the Commission approve the interconnection agreement?

2. TC00-072 IN THE MATTER OF THE APPLICATION OF SIESTA TELECOM, INC. FOR A CERTIFICATE OF AUTHORITY TO PROVIDE TELECOMMUNICATIONS SERVICES IN SOUTH DAKOTA. (Staff Analyst: Keith Senger. Staff Attorney: Karen Cremer.)

Siesta Telecom, Inc. is seeking a Certificate of Authority to provide resold interexchange telecommunication services, in South Dakota. The applicant intends to offer 1+ and 101XXXX outbound dialing, toll free inbound dialing, travel card and prepaid calling card services using Qwest Communications as its underlying carrier.

TODAY, shall the Commission grant a Certificate of Authority to Siesta Telecom, Inc.?
