ADDENDUM TO THE AGENDA OF THE COMMISSION MEETING

Telecommunications

1. TC96-107 IN THE MATTER OF THE ESTABLISHMENT OF SWITCHED ACCESS RATES FOR U S WEST COMMUNICATIONS, INC. (Staff Analyst: Harlan Best. Staff Attorney: Karen Cremer.)

On June 24, 1996, U S WEST Communications, Inc. (U S WEST) filed for approval by the Commission its 1995 switched access cost study. According to the application, the study develops an overall average calculated rate of $0.066 cents per minute required to recover the costs. The following companies were granted intervention on July 30, 1996: Sprint Communications Company (Sprint); MCI Telecommunications Corporation (MCI); Express Communications, Inc. (Express); AT&T Communications of the Midwest, Inc. (AT&T); Telecommunications Action Group (TAG); and Dakota Cooperative Telecommunications, Inc. (DCT). The Commission also found that pursuant to SDCL 49-31-12.4, the rate increase should be suspended for 120 days. The Commission directed the Executive Director to set a procedural schedule. On August 30, 1996, the Commission granted a motion from AT&T seeking permission to serve its first set of data requests and requests for production of documents upon U S WEST and to expedite discovery. A hearing was held in this matter beginning on October 9, 1996, in the State Capitol Building.

TODAY, shall the Commission approve U S WEST's application to increase its Carrier Common Line Access Charge and its Interconnect and Local Switching rates?

2. TC96-167 IN THE MATTER OF THE SALE OF THE STOCK OF KADOKA TELEPHONE CO. TO MJD HOLDINGS CORP. (Staff Analysts: Tammi Hendrix and Dave Jacobson. Staff Attorney: Camron Hoseck.)

On September 26, 1996, the Commission received a joint application from Kadoka Telephone Co. and MJD Holdings Corp., collectively referred to as Applicants. The Applicants jointly apply to the Commission for approval of the sale of the stock of Kadoka Telephone Company to MJD Holdings Corp. On September 26, 1996, the Commission electronically transmitted notice of the filing and the intervention deadline of October 11, 1996, to interested individuals and entities. No parties have sought intervention in this docket. A hearing was held in this matter on December 4, 1996, in Kadoka.

TODAY, shall the Commission approve the sale of the stock of Kadoka Telephone Company to MJD Holdings Corp?

3. TC96-175 IN THE MATTER OF THE APPLICATION OF PAM OIL, INC. D.B.A. PAM COMMUNICATIONS FOR A CERTIFICATE OF AUTHORITY TO PROVIDE LOCAL EXCHANGE ACCESS AND EXCHANGE ACCESS SERVICES IN SOUTH DAKOTA. (Staff Analyst: Harlan Best. Staff Attorney: Camron Hoseck.)

On October 8, 1996, the Commission received an application from PAM Oil, Inc., d.b.a. PAM Communications (PAM) for a Certificate of Authority to provide local exchange access and exchange access services within the state of South Dakota. PAM intends to provide telecommunication services including local exchange services, intraLATA services, and as applicable, interLATA services, in the state of South Dakota. On October 10, 1996, the Commission electronically transmitted notice of the filing and the intervention deadline of October 26, 1996, to interested individuals and entities. Intervention in this docket was granted to the South Dakota Independent Telephone Coalition, Inc. (SDITC), and Dakota Cooperative Telecommunications, Inc. (DCT). On December 3, 1996, SDITC and PAM filed a stipulation and agreement with the Commission whereby SDITC agreed to withdraw as an intervenor. On December 5, 1996, a hearing was held in this matter in Room 423 of the State Capitol Building.

TODAY, shall the Commission grant PAM a Certificate of Authority to provide local exchange, intraLATA (intrastate) and interLATA services within the state of South Dakota?

4. TC96-194 IN THE MATTER OF THE FILING BY U S WEST COMMUNICATIONS, INC., MCI TELECOMMUNICATIONS CORPORATION, TELEPORT COMMUNICATIONS GROUP AND AT&T COMMUNICATIONS OF THE MOUNTAIN STATES, INC. OF A JOINT MOTION FOR LOCAL TELECOMMUNICATIONS CARRIER PARTICIPATION IN THE WESTERN REGION TELEPHONE NUMBER PORTABILITY, LLC. (Staff Analyst: Tammi Hendrix. Staff Attorney: Karen Cremer.)

On December 5, 1996, the Commission received a Joint Motion For Local Telecommunications Carrier Participation In The Western Region Telephone Number Portability, LLC submitted by U S WEST Communications, Inc., MCI Telecommunications Corporation, Teleport Communications Group, and AT&T Communications Of The Mountain States, Inc. According to the filing: "The Commission should issue a decision allowing incumbent and potential providers in South Dakota to participate in the Western Region Telephone Number Portability, LLC to provide the most cost effective solution to LNP. The Commission decision should be issued as soon as possible to allow for providers not already participating in the LLC as a result of some other state's action to participate in the selection of the vendor prior to December 16, 1996."

TODAY, shall the Commission approve the participation of incumbent and potential telecommunications providers in the Western Region Telephone Number Portability, LLC?
