On June 21, 2011, NorthWestern Corporation, dba NorthWestern Energy filed for Approval of a Contract with Deviations. The proposed contract would provide electric service to an agricultural business with the customer paying a portion of the cost to extend service to the customers location. Inclusion of these costs would place the charges outside the tariffed rates currently on file with the Commission.

TELECOMMUNICATIONS
On June 21, 2011, OrbitCom, Inc. (OrbitCom) filed an application for approval of the company's switched access Tariff No. 2, to replace original Tariff No. 1. In Tariff No. 2, the company has modified its switched access rates to comply with the Commissions Order in RM05-002 requiring CLECs to conform to the rates of the Regional Bell Operating Company. Additionally, further revisions are included in Tariff No. 2 to clarify policies and further define rate categories. Orbitcom has proposed an effective date of May 30, 2011.

On June 22, 2011, Midstate Telecom, Inc. (Midstate) filed a petition for approval of its new intrastate switched access rates. Per ARSD 20:10:27:02.02, Midstate requested the Commission approve a higher rate than allowed under ARSD 20:10:27:02.01 and filed a cost study in support of the higher rate. Midstate also requested a phase-in period in which their current rate would be approved until November 30, 2011, after which the requested rate would go into effect.
