EL11-006     In the Matter of the Complaint by Oak Tree Energy LLC against NorthWestern Energy for refusing to enter into a Purchase Power Agreement

On April 28, 2011 Oak Tree Energy LLC (Oak Tree) filed a complaint against NorthWestern Energy (NWE). Oak Tree is developing a wind project within NWE's service territory.  Oak Tree argues the project is a "Qualified Facility" under PURPA regulations and as a result NWE is required to purchase power produced by the wind farm. Oak Tree alleges that NWE refuses to enter into a purchase power agreement and requests the Commission hear and resolve all issues.

EL11-007     In the Matter of the Petition for Declaratory Ruling of Black Hills Power, Inc., regarding the Proposed Black Hills Power Wind Project

On April 28, 2011, Black Hills Power, Inc. (BHP) filed a petition asking the Commission to make a declaratory ruling on whether BHP properly evaluated and determined under SDCL 49-34A-101 through 104, that the proposed BHP Wind Project is: i) reasonable and cost effective considering other electricity alternatives; and ii) an appropriate resource addition to meet BHP's resource or customer needs.

SDCL 49-34A, Sections 101 through 104, address the South Dakota renewable, recycled, and conserved energy objective of ten percent of all electricity sold at retail within the state by the year 2015 be obtained from renewable, recycled and conserved energy sources. The statutes also provide guidance on qualifying sources of renewable energy and relevant cost considerations of any renewable, recycled and conservation investments.

EL11-008     In the Matter of the Filing by Otter Tail Power Company Regarding Its 2010 and 2011 Energy Efficiency Plan Update

On April 29, 2011, the Commission received a filing from Otter Tail Power Company (Otter Tail) requesting approval of the financial incentive for the 2010 Energy Efficiency Plan and also requests approval to continue the energy adjustment surcharge as part of its 2011 Energy Efficiency Plan update.

EL11-009     In the Matter of the Application of Black Hills Power, Inc. for Approval of its Electric Cost Adjustment 

On April 29, 2011, the Commission received an application by Black Hills Power, Inc. for approval of 2011 Electric Cost Adjustment. The ECA for Black Hills Power was approved in Docket No. EL09-018 (the "EL09-018 ECA"). The EL09-018 ECA consists of two separate adjustments: 1) the Fuel and Purchased Power Adjustment (FPPA); and 2) the Transmission Cost Adjustment (TCA). Each adjustment applies to all rate schedules for all classes of service authorized by the Commission. The annual increase in the cost of service is approximately $1,000,000 or 0.68% higher than the revenue billed to customers during the twelve months ending March 31, 2011. The Company states that overall, the increase to customers is primarily related to increased transmission costs for their system.

TC11-019     In the Matter of the Filing by 360networks (USA) inc. for Approval of Revisions to its Intrastate Switched Exchange Access Tariff No. 1 and Request for a Waiver

On May 04, 2011, the Commission received a filing from 360networks(USA) inc for changes to its switched access tariff sheets 2, 51, 52 and 54, which address changes to the switched access rates and reintroduces a Toll Free Data Base Access Service. 360networks also requests a waiver of ARSD 20:10:27:07 and requests an effective date of June 6, 2011.
