ELECTRIC
On June 4, 2010, the Commission received an application from Montana-Dakota Utilities Co. (MDU) for approval to revise its Occasional Power Purchase Non-Time Differentiated Rate 95, Short-Term Power Purchase Time Differentiated Rate 96 and Long-Term Power Purchase Time Differentiated Rate 97. The filing is made in compliance with the Commission's Order in F-3365 and in accordance with the Special Terms and Conditions of these tariffs, which state that the rate schedules will be reviewed annually and revised when necessary. MDU is also requesting a revision to the Company's Short Term Power Purchase Time Differentiated Rate 96 and Long Term Power Purchase Time Differentiated Rate 97 tariffs to remove the time of day provision with respect to the energy payment. The current tariff provides for an on- and off-peak energy payment with the on-peak hours defined as those hours between 12:00 p.m. and 8:00 p.m., Monday through Friday in the months of June through September. All remaining hours are defined as off-peak hours. Given the narrowing of the differential between the on-peak and off-peak energy prices, the Company believes at this time a time differentiated provision for the energy payment is no longer warranted.

NG10-003 - In the Matter of the Filing by NorthWestern Corporation dba NorthWestern Energy for Approval of a Contract with Deviations
On June 9, 2010, the Commission received an application by NorthWestern Corporation dba NorthWestern Energy (NorthWestern) for approval of a contract with deviation to construct a natural gas line to serve the South Dakota Wheat Growers Aberdeen East Facility. NorthWestern will install, or arrange for the installation of, approximately 1/2 mile of 4-inch pipeline. The deviated rate will allow NorthWestern to fully recover the cost of the upgrade, after which the customer will revert back to Rate 86 tariffed rates.

NorthWestern will upgrade, or arrange for the upgrade, to a 4-inch pipeline. The deviated rate will allow NorthWestern to fully recover the cost of the upgrade, after which the customer will revert back to Rate 86 tariffed rates.

PIPELINE SAFETY
On June 3, 2010, the Pipeline Safety Staff requested the Commission open a docket and hire experts to determine if damage prevention efforts in South Dakota can be improved. According to a recent PHMSA survey of damage prevention, South Dakota was deficient in the following three damage prevention areas: (1) Employee training; (2) Public education; and (3) Data analysis. Pipeline safety has jurisdiction over gas pipeline operators in South Dakota and is evaluated by PHMSA regarding its damage prevention efforts. South Dakota's program can be improved through complete analysis of deficient areas listed above and determination regarding whether these elements are applicable and appropriate for implementation in South Dakota.

TELECOMMUNICATIONS
On June 3, 2010, the Commission received a filing for approval of a reciprocal interconnection, transport and termination agreement between Cheyenne River Sioux Tribe and Alltel Communications, LLC for the state of South Dakota. Any party wishing to comment may do so by filing written comments with the Commission and the parties to the Agreement no later than June 23, 2010. Parties to the Agreement may file written responses to the comments no later than twenty days after the service of the initial comments.

On June 4, 2010, the Commission received a petition by MCC Telephony of the Midwest, LLC (MCC) for approval of its Initial Access Services Tariff to be effective on or before July 4, 2010. MCC also petitioned for an exemption from ARSD 20:10:27:11 and a waiver or suspension of ARSD 20:10:27:12, 20:10:27:13, and 20:10:27:07 in order for MCC to set its price for primary intrastate switched access services to mirror the rates established by Qwest Communications, Inc.
