NG09-005       In the Matter of the Filing by NorthWestern Energy for Approval of Tariff Revisions. 

Application by NorthWestern Energy to update its fuel retention percentage for natural gas transportation service. NorthWestern Energy's tariff provides that the fuel retention percentage be adjusted annually with the updated percentage to be effective October 1 of each year

ONE CALL COMPLAINT

OC09-007       In the Matter of the Complaint filed by South Dakota Network, LLC, Sioux Falls, South Dakota, against Larry's Electric, Pierre, South Dakota.

On September 2, 2009, William P. Heaston, South Dakota Network, LLC filed a complaint against Larry's Electric, Pierre, South Dakota, alleging a violation of SDCL 49-7A-8.  The complaint alleges that alarms at SDN indicated a fiber cut in Pierre on the core state fiber.

ONE CALL RULES

OR09-001       In the Matter of Revisions and/or Additions to the One Call Notification Board Rules.

A public hearing will be held in Room 413, 4th Floor, State Capitol, Pierre, South Dakota, on September 30, 2009, at 10:00 a.m., to consider the adoption and amendment of proposed rules numbered: 20:25:01:01, 20:25:02:06, 20:25:03:01, 20:25:03:05.04, 20:25:03:07 and 20:25:03:10.02.  The One-Call Notification Board is responsible for administering the one-call notification system for the location of underground facilities.  It proposes modifications to existing rules.  The primary reason for the proposed rule changes is to respond to the request from the Pipeline Safety Task Force with the intent of improving the safety of the excavators and reduce the potential for damage to a high profile underground facility. There are also some minor changes that will serve to improve the efficiency of the South Dakota One Call System.  The reasons for the proposed rule changes are to improve the efficiencies of the South Dakota One Call System by clarifying and modifying the Administrative Rules that have been identified by the users of the system as requiring improvement.

Persons interested in presenting data, opinions, and arguments for or against the proposed rules may do so by appearing in person at the hearing or by sending them to the One-Call Notification Board, % South Dakota Public Utilities Commission, State Capitol, 500 East Capitol, Pierre, South Dakota 57501-5070.  Material sent by mail must reach the Public Utilities Commission prior to the hearing to be considered.

TC09-087        In the Matter of the Filing for Approval of a Resale Agreement between Qwest Corporation and iNetworks Group, Inc.

On August 28, 2009, the Commission received a filing for approval of a Resale Agreement between Qwest Corporation and iNetworks Group, Inc.  Any party wishing to comment on the Agreement may do so by filing written comments with the Commission and the parties to the Agreement no later than September 17, 2009.  Parties to the Agreement may file written responses to the comments no later than twenty days after service of the initial comments.
