CT08-007 In the Matter of the Complaint filed by Keller Electric, Pierre, South Dakota, against Nationwide Long Distance Service Regarding Unauthorized Switching of Services.
Complaint by Keller Electric against Nationwide Long Distance Service regarding the unauthorized long distance charges billed to it. The Complainant contends Nationwide Long Distance charged it for services it neither ordered nor authorized. The Complainant requests corrective action as authorized according to South Dakota statutes.

ELECTRIC
Application by Otter Tail Power Company (OTP) for approval to increase rates for electric service to customers in its service territory by $3,883,399 annually or approximately 15.3% based on OTP's 2007 test year. The company states the proposed increase for a residential customer would be $10.68 per month or 15.0%. The proposed rates may potentially affect approximately 11,700 customers in OTP's service territory.

On October 31, 2008, Buffalo Ridge II LLC, a subsidiary of Iberdrola Renewables, Inc., submitted an application for an Energy Conversion Facility Permit for the Construction of the Buffalo Ridge II Wind Farm and Associated Collection Substation and Electric Interconnection System. The applicant proposes to construct and operate a wind farm on up to 77 acres dispersed throughout portions of up to 77 sections of land in Brookings and Deuel County as well as a 13-mile long 115 kilovolt overhead transmission line. The proposed wind farm could have a name plate capacity of up to 306 megawatts.

TELECOMMUNICATIONS
On October 30, 2008, the Commission received a filing for approval of an Interconnection Agreement between Qwest Corporation and QuantumShift Communications, Inc. d/b/a vCom Solutions. Any party wishing to comment on the Agreement may do so by filing written comments with the Commission and the parties to the Agreement no later than November 20, 2008. Parties to the Agreement may file written responses to the comments no later than twenty days after service of the initial comments.

On October 31, 2008, Qwest filed a request to modify the Jurisdictional Report Requirements in Section 2, by establishing a Percent Interstate Usage (PIU) floor for unidentified Feature Group D (FGD) terminating traffic. Terminating FGD traffic that does not contain sufficient call detail to identify the jurisdiction (unidentified traffic) will be assigned jurisdiction as follows:
• The first 5% of unidentified terminating traffic will continue to be jurisdictionally assigned based on the carrier's PIU report or, if the carrier has not filed a PIU report, a PIU of 50 (50% interstate – 50% intrastate) will be assigned per the current terms in Section 2.3.10.B.2.c.
• Unidentified traffic in excess of the 5% floor will be designated intrastate traffic and charged at Qwest's current South Dakota rates.
There is no change to currently effective rates. Notification has been sent to customers.
