EL08-025        In the Matter of the Application of Otter Tail Corporation to Form a New Holding Company.

            Application by Otter Tail Corporation pursuant to SDCL 49-34A-36 for approval to form a new holding company pursuant to an Agreement and Plan of Merger. As part of the transaction, a new, legally separate Otter Tail Power Company will become a subsidiary of the holding company. Other parties to the transactions are OT Holding Company ("Holding Company") and OT Merger Co. ("Merger Co."). This restructuring will fulfill the Company's requirements for utilities under South Dakota Senate Bill 40, which the Governor signed into law on March 17, 2008.

EL08-026        In the Matter of the Joint Request for an Electric Service Rights Exception between Sioux Valley Energy and Central Electric Cooperative, Inc.

            Application by Sioux Valley Southwestern Electric Cooperative, Inc. (SVE) and Central Electric Cooperative, Inc. (CEC) for approval of a territory exception which would allow CEC to provide electric service to a new rural service in SVE's territory in the Northwest quarter of Section 7, Township 105 North, Range 54 West, in Lake County, South Dakota.

EL08-027        In the Matter of the Filing by Montana-Dakota Utilities Co. for Approval of Tariff Revisions.

            Application by Montana-Dakota Utilities Co. for approval to change the effective date of the Fuel Clause Adjustment tariff from bills rendered to a service rendered basis. Montana-Dakota is in the process of integrating its Automated Meter Reading (AMR) system. To avoid potential effects on customers resulting from billing periods longer or shorter than normal, Montana-Dakota proposes to implement its FCA on a service rendered basis. An additional advantage of a service rendered FCA is that it will provide for an equitable sharing of costs among all customers, regardless of their meter read cycle.

OC08-006       In the Matter of the Complaint filed by NorthWestern Energy, Huron, South Dakota, against Vanderpol Dragline, Inc., Mitchell, South Dakota.

            On September 10, 2008, the South Dakota One Call Notification Board received a complaint filing from NorthWestern Energy.  According to the complaint, on August 25, 2008, Vanderpol Dragline, Inc. of Mitchell, SD did not follow all necessary statutory precautions to avoid facility damage while excavating for a road construction project.  Property damage did occur.  In addition, the Complainant asks for consideration under SDCL 49-7A-19 as previous complaints have been filed against the alleged offender.

TC08-109        In the Matter of the Application of Native American Telecom, LLC for a Certificate of Authority to Provide Local Exchange Service on the Pine Ridge Indian Reservation.

            On  September 9, 2008, Native American Telecom, LLC filed an application for a certificate of authority to provide local exchange telecommunications services on the Pine Ridge Indian Reservation in the State of South Dakota. Native American Telecom, LLC plans to provide facility based services using advanced wireless technologies and/or fiber optic and other wireline technology.

            Application by Network Innovations, Inc. for a Certificate of Authority to Provide Interexchange Telecommunications Service in the State of South Dakota. Applicant is a reseller of telecommunications services which provides resold dedicated point-to-point private line service and dedicated Internet access to business customers only. Applicant intends to operate through larger carriers now serving the State of South Dakota through SDPUC approved interconnection agreements.

TC08-112        In the Matter of the Filing for Approval of an Amendment to an Interconnection Agreement between Qwest Corporation and MCImetro Access Transmission Services. LLC.

        On September 10, 2008, the Commission received a filing for approval of an Originated Toll Free Service Jointly Provided Switched Access (JPSA) Amendment to the Interconnection Agreement between Qwest Corporation and MCImetro Access Transmission Services, LLC for the State of South Dakota.  Any party wishing to comment on the Agreement may do so by filing written comments with the Commission and the parties to the Agreement no later than September 30, 2008.  Parties to the Agreement may file written responses to the comments no later than twenty days after service of the initial comments.
