EL08-016 - In the Matter of the Application of East River Electric Power Cooperative, Inc. for a Permit to Construct 9.5 miles of 115 kV Transmission Line in Lincoln and Turner Counties.

On June 12, 2008, East River Electric Power Cooperative, Inc. submitted an application for a Construction Permit to build a 9.5 mile 115 kV transmission line between the Virgil Fodness High Voltage Substation located south of Tea in Lincoln County and the Chancellor Substation located east of Chancellor in Turner County. The line is needed to serve the expansion of an ethanol plant served by East River's member system, Southeastern Electric Cooperative, Inc., as well as other loads which continue to grow in Turner and Lincoln Counties.

OC08-002       In the Matter of the Complaint filed by Southeastern Electric Cooperative, Inc., Marion, South Dakota, against Empire Construction, Sioux Falls, South Dakota.

            On June 12, 2008, the South Dakota One Call Notification Board received a complaint filed by Tim Chance of Southeastern Electric Cooperative, Inc., Marion, SD.  According to the complaint, Empire Construction of Sioux Falls, SD failed to request a locate, yet began excavation work at 7313 W. 65th Street, Sioux Falls, SD on December 10, 2007.  The excavation resulted in damage to Southeastern Electric Cooperative, Inc.'s facilities.

RULEMAKING

RM08-001       In the Matter of the Revisions and/or Additions to the Commission's Rules Regarding Public Warehouses, Grain Dealers and Pipeline Operators.

A public hearing will be held in Room 464, 4th Floor, State Capitol, Pierre, South Dakota, on July 14, 2008, at 10:00 a.m., to consider the adoption and amendment of proposed rules numbered:  20:10:11:03, 20:10:11:04, 20:10:11:04.01, 20:10:11:06, 20:10:11:07, 20:10:11:08, 20:10:11:09, 20:10:11:09.01, 20:10:11:11, 20:10:11:12, 20:10:11:13, 20:10:11:18, 20:10:12:05, 20:10:12:08, 20:10:12:09, 20:10:12:10, 20:10:12:11, 20:10:12:12, 20:10:12:13, 20:10:12:14, 20:10:12:16, 20:10:12:17, 20:10:31:04 and 20:10:31:05. The proposed rules affect grain buyers, public warehouses, and the timing of the assessment of fees on pipeline operators. Persons interested in presenting data, opinions, and arguments for or against the proposed rules may do so by appearing in person at the hearing or by sending them to the South Dakota Public Utilities Commission, State Capitol, 500 East Capitol, Pierre, South Dakota 57501-5070.  Material sent by mail must reach the Public Utilities Commission by July 24, 2008, to be considered.  Copies of the proposed rules may be obtained without charge from the
