OC08-001-  In the Matter of the Complaint filed by Jeff Thompson, Dakota Dunes, South Dakota, against Larry Albenesius, Jackson, Nebraska.
 
            On April 21, 2008, the South Dakota One Call Notification Board received a filing of a complaint by Jeff Thompson against Larry Albenesius of PO Box 93, Jackson, Nebraska 68743.  According to the complaint, Larry Albenesius excavated at 707 Prairie Blvd, Dakota Dunes, SD prior to the start date on the ticket, did not adequately preserve facility marks and did not properly expose facilities by hand.

PS08-002 -  In the Matter of the Filing by NorthWestern Corporation d/b/a NorthWestern Energy for approval of a waiver of 49 C.F.R. Sections 192.285(a)(2) and 192.285(c).
 
            On April 21, 2008, the Commission received a filing from NorthWestern Corporation d/b/a NorthWestern Energy requesting approval of a permanent waiver of 49 C.F.R. Sections 192.285(a)(2) and 192.285(c).  NorthWestern Corporation requests a waiver of Part 192.285(c) to allow it to re-qualify its employees by an alternate means of assuring qualifications for persons making joints.

TC08-041 -  In the Matter of the Application of Momentum Telecom, Inc. for a Certificate of Authority to Provide Interchange Telecommunications Services and Local Exchange Services in South Dakota.

On April 21, 2008, Momentum Telecom, Inc. (Momentum) filed an application for a certificate of authority with the Public Utilities Commission (Commission). Momentum's application is for authority to provide facilities-based local exchange and exchange access telecommunications services throughout the service territory of Qwest Corporation. On April 22, 2008, Momentum filed an application for a certificate of authority with the Commission to provide resold interexchange telecommunications services throughout the service territory of Qwest Corporation.  Momentum requests confidential treatment of its financial information.
