On April 6, 2007, Black Hills Electric Cooperative, Inc. (BHEC) and Black Hills Power, Inc. (BHP) filed for Commission approval a Service Territory Transfer Agreement between BHEC and BHP. BHP agrees to transfer to BHEC a frozen customer and four lots in Sections 19 and 30, Township 1 South, Range 5 East, Black Hills Meridian, Pennington County, South Dakota. It is the opinion of both BHEC and BHP that this transfer of service area is in the best interests of both parties, as well as in the public interest.

On April 9, 2007, the South Dakota One Call Notification Board received a filing of a complaint by Tim Chance of Southeastern Electric Cooperative, Inc. against JHK Excavating of 46591 – 277th Street, Lennox, South Dakota. According to the complaint, JHK Excavating was excavating at 7505 W. 64th Street, Sioux Falls, South Dakota, without first obtaining a valid locate request.

TELECOMMUNICATIONS
On April 5, 2007, the Commission received a filing for the approval of an Amendment regarding certain reciprocal compensation and network interconnection rates, terms and conditions to the interconnection agreement between Qwest Corporation and MCImetro Access Transmission Services, LLC for the State of South Dakota. Any party wishing to comment on the Agreement may do so by filing written comments with the Commission and the parties to the Agreement no later than April 25, 2007. Parties to the Agreement may file written responses to the comments no later than twenty days after service of the initial comments.

On April 6, 2007, Matrix Telecom, Inc. d/b/a Matrix Business Technologies (Matrix) submitted a request for an exemption from developing company specific cost-based switched access rates (ARSD 20:10:27:07) and a waiver of ARSD 20:10:27:12 requiring Matrix to base its switched access rates on the costs of all telecommunications companies with less than 100,000 access lines. Matrix proposes to mirror the intrastate switched access rates of Qwest Corporation.
