RM05-001 In the Matter of Revisions to the Energy Facility Siting Rules.
On September 28, 2005, the Commission opened this rulemaking docket regarding energy facility siting rules. The siting rules set forth the information that is required to be provided by an applicant. The proposed rule amendments add wind energy facilities to the siting rules and list the specific requirements for a wind energy facility application. In addition, one of the proposed rules, 20:10:22:33.01, sets forth the requirements for the removal of wind energy facilities and possible bonding or other financial requirements to ensure removal. Another proposed rule amendment, 20:10:22:04 decreases the required number of paper copies of an application and requires the application to be filed electronically. Another proposed rule amendment, 20:10:22:05, requires applications to list all permits needed from any state or federal entity. Most of these rule changes are a result of legislative changes to the Commission's energy facility siting laws. A hearing will be held on November 1, 2005 at 9:30 a.m. in Room 412 of the State Capitol. Written comments are due on or before November 14, 2005.

On September 22, 2005, the Commission received a filing for the approval of a Wireline Interconnection Agreement between Qwest Corporation and Budget Phone, Inc. According to the parties, the Agreement sets forth the terms, conditions and pricing under which Qwest will provide Budget Phone, Inc. network Interconnection. Any party wishing to comment on the Agreement may do so by filing written comments with the Commission and the parties to the Agreement no later than October 12, 2005. Parties to the Agreement may file written responses to the comments no later than twenty days after the service of the initial comments.

On September 22, 2005, the Commission received a filing for the approval of Qwest's Master Services Agreement. Qwest Corporation and Budget Phone, Inc, have executed a commercial agreement related to the provisions of switching and shared transport. The Master Services Agreement is being filed in compliance with the Commission's Order dated October 29, 2004 in Docket TC04-144. In its cover letter Qwest stated that, "Qwest has disputed and will continue to dispute, that the (Master Services) Agreement and similar commercial arrangements between Qwest and CLECs are ICAs that must by filed with the Commission for approval pursuant to Section 252 of the Act. Notwithstanding this position, and without waiving any of its rights or arguments on these issues, Qwest is filing the Agreement as set forth above. Qwest is making the filing solely to avoid further controversy or disputes with the Commission regarding the appropriate legal status of the Agreement. . . ." Any party wishing to comment on the Agreement may do so by filing written comments with the Commission and the parties to the Agreement no later than October 12, 2005. Parties to the Agreement may file written responses to the comments no later than twenty days after the service of the initial comments.

On September 23, 2005, the Commission received a filing for the approval of an Agreement for Terms and Conditions for Interconnection, Unbundled Network Elements, Ancillary Services and Resale of Telecommunications Services between Qwest Corporation and DIECA Communications, Inc. d/b/a Covad Communications Company. According to the parties, the Agreement sets forth the terms, conditions and pricing under which Qwest will provide DIECA Communications, Inc. d/b/a Covad Communications network Interconnection. Any party wishing to comment on the Agreement may do so by filing written comments with the Commission and the parties to the Agreement no later than October 13, 2005. Parties to the Agreement may file written responses to the comments no later than twenty days after the service of the initial comments.

On September 23, 2005, the Commission received a filing for the approval of a Line Splitting Amendment to an Interconnection Agreement between Qwest Corporation and DIECA Communications, Inc. d/b/a Covad Communications Company. According to the parties, the Agreement adds terms and conditions to the Line Splitting Agreement between Qwest and DIECA Communications, Inc. d/b/a Covad Communications. Any party wishing to comment on the Agreement may do so by filing written comments with the Commission and the parties to the Agreement no later than October 13, 2005. Parties to the Agreement may file written responses to the comments no later than twenty days after the service of the initial comments.
