Application by Black Hills Power, Inc. (BHP) for approval to increase rates for electric service to customers in its service territory by $9,593,688 annually or approximately 9.5% based on BHP's 2005 test year. The company states the proposed increase for a residential customer would be $5.16 per month based on usage of 600 kwh. The proposed rates may potentially affect approximately 60,434 customers in BHP's service territory.

RM06-002 In the Matter of the Adoption of Rules Regarding Public Warehouses
The Commission opened this rulemaking docket to consider the adoption and amendment of rules regarding public grain warehouse storage. One of the proposed changes would amend the construction requirements for temporary public grain storage units. Another proposed rule allows for seasonal emergency storage which would allow a public grain warehouse to store grain outside between July 1 and January 31. Another proposed rule allows for non-seasonal emergency storage which would allow a public grain warehouse to store grain outside between February 1 and June 30. Commission approval will be needed for non-seasonal emergency storage. For temporary, seasonal, and non-seasonal storage, a warehouse operator will be required to keep a separate record of the grain. A public hearing will be held at DDN-Pierre, Room B12, State Capitol, 500 East Capitol, Pierre, South Dakota, and DDN-Sioux Falls, Room 189, 2205 Career Place, Sioux Falls, South Dakota, on August 8, 2006, at 8:30 a.m., to consider the adoption and amendment of proposed rules 20:10:11:13, 20:10:11:16 and 20:10:11:17. Persons interested in presenting data, opinions, and arguments for or against the proposed rules may do so by appearing in person at the hearing or by sending them to the South Dakota Public Utilities Commission, State Capitol, 500 East Capitol, Pierre, South Dakota 57501-5070. Material sent by mail must reach the Public Utilities Commission by August 18, 2006, to be considered. TELECOMMUNICATIONS
On June 30, 2006, City of Brookings Municipal Telephone Department filed a 2005 switched access cost study developing a revenue requirement and minutes of use that are included in the revenue requirement and minutes of use used to determine the switched access rates for the Local Exchange Carriers Association.

On July 3, 2006, James Valley Wireless, L.L.C. (JVW) filed a Petition for Designation as an Eligible Telecommunications Carrier (ETC) for its proposed wireless personal communications service operations. JVW requests that its proposed wireless operation be designated as eligible to receive all available support from the federal Universal Service Fund including, but not limited to, support for rural, insular and high-cost areas and low-income customers. JVW requests that it be designated as an ETC in the James Valley Cooperative Telephone Company's service area and the Redfield exchange of Qwest Corporation.

On July 3, 2006, Heartland Telecommunications of Iowa d/b/a HickoryTech (Heartland) filed a Petition For a Waiver of ARSD Sections 20:10:32:52 to 20:10:32:54, inclusive. Heartland's study area is comprised primarily of a geographic area contained within the state of Iowa, but also includes small portions of rural territory in South Dakota and Minnesota. Heartland's service area in South Dakota consists of West Arkon and West Hawarden. Heartland states that it will comply with the final rulemaking order of the Iowa Utilities Board (IUB) to determine the annual reporting and certification requirements for all carriers with eligible telecommunications carrier (ETC) designation (RMU 06-1). For companies that have a very small portion of their overall study area in South Dakota, the requirement of certifying the use of federal Universal Service Fund monies per the requirements of the above referenced rules are "unduly burdensome and unnecessary" for the Commission to certify that Heartland is using the federal high cost support for the uses it is intended. Because its study area is largely contained within the state of Iowa and because it will comply with the IUB requirements for ETC certification, Heartland requests that it be allowed to file a copy of its Iowa ETC certification with the SDPUC; and that the SDPUC accept such filing as sufficient to make the determination as to include Heartland on the list of certified carriers it provides to the FCC on or before October 1 of each year.

On June 30, 2006, the Local Exchange Carriers Association (LECA) filed revised switched access tariff pages. These revisions are necessitated by revisions in the individual member companies' revenue requirements and access minutes of use. The revised tariff pages are proposed to be effective upon Commission approval of the corresponding cost studies.
