CE06-003      In the Matter of the Complaint filed by Global Polymer Industries, Inc., Arlington, South Dakota, against the City of Arlington Regarding Electrical Service 

On June 7, 2006, Global Polymer Industries, Inc. (Polymer) filed a complaint against the City of Arlington regarding adequate electrical service pursuant to SDCL 49-34A-58. Polymer is requesting that the Commission allow Polymer to contract with another electric utility for its retail electric service.

EL06-017      In the Matter of the Filing by Montana-Dakota Utilities Co. for Approval of Tariff Revisions 

Montana-Dakota Utilities Co. is seeking approval to revise its Occasional Power Purchase Non-Time Differentiated Rate 95, Short-Term Power Purchase Time Differentiated Rate 96 and Long-Term Power Purchase Time Differentiated Rate 97. The filing is made in compliance with the Commission's Order in F-3365 and in accordance with the Special Terms and Conditions of these tariffs which state that the rate schedules will be reviewed annually and revised when necessary.

EL06-018      In the Matter of the Consideration of the New PURPA Standards 

On August 8, 2005, the Energy Policy Act of 2005 ("EPAct 2005") was signed into law. Certain provisions in the EPAct 2005 amend the Public Utility Regulatory Policies Act ("PURPA") of 1978. The EPAct 2005 adds five new federal standards to PURPA. The five standards regard net metering, fuel diversity, fossil fuel generation efficiency, smart metering, and interconnection for distributed resources. Under the EPAct 2005, the Public Utilities Commission (Commission) has varying timelines within which to consider these standards and determine whether to adopt them. The Commission voted to open a docket to seek comments from interested persons or entities on how to proceed.

GAS AND ELECTRIC 

GE06-001      In the Matter of the Merger between NorthWestern Corporation and BBI Glacier Corp., a Subsidiary of Babcock & Brown Infrastructure Limited 

Northwestern Corporation ("NorthWestern") and Babcock & Brown Infrastructure Limited ("BBIL") have entered into an agreement and plan of merger, dated as of April 25, 2006, which is pending approval of the stockholders of Northwestern at its annual meeting to be held on August 2, 2006. In connection with this transaction (the "Transaction") , a question has arisen as to whether the South Dakota Public Utilities Commission (Commission) has jurisdiction to approve the Transaction. Thus, NorthWestern and BBIL have filed a petition for a declaratory ruling pursuant to SDCL § 1-26-15 and ARSD 20:10:01:34. If the Commission concludes that it does in fact have jurisdiction, a second question is presented, namely, will the Commission approve the transaction.

OC06-004      In the Matter of the Complaint filed by Northern Natural Gas, Harrisburg, South Dakota, against Heil Electric, Woonsocket, South Dakota 

One June 2, 2006, the South Dakota One Call Notification Board received a filing of a complaint by Northern Natural Gas against Heil Electric of Woonsocket, South Dakota.  According to the complaint, Heil Electric did not wait until the indicated start date/time on the locate ticket before commencing excavation at a high pressure gas pipeline located at 47493 272nd Street in Harrisburg, South Dakota.

TC06-054      In the Matter of the Application of Integrated Services, Inc. for a Certificate of Authority to Provide Interexchange Telecommunications Services in South Dakota 

On June 1, 2006, Integrated Services Inc. filed an application seeking a Certificate of Authority to interexchange telecommunications services, including 1+ and 101XXXX outbound dialing, 800/888 Toll-Free inbound dialing, directory assistance, data services and postpaid calling card services to residential customers and small and mid-sized business customers within the State of South Dakota.
