CT01-034 In the Matter of the Complaint filed by Holzwarth Sales & Service, Inc., Gettysburg, South Dakota, against Excel Telecommunications, Inc. Regarding Unauthorized Billing for Services.

Complainant's representative states he switched phone service from Excel Telecommunications to another provider. Complainant's representative notified Excel Telecommunications that he no longer wanted its service. Approximately one year later the Complainant received a bill from Excel for $118.36. Complainant also received a bill from a collection agency for $531.26. Complainant's representative is requesting that the Excel bill and the collection charges be eliminated.

CT01-035 In the Matter of the Complaint filed by Joan M. Horstman, Sioux Falls, South Dakota, against Touch America, Inc. and Sprint Communications Company L.P. Regarding Unauthorized Switching of Services and Billing for Services.

Complainant states that on two occasions Touch America has represented itself as her long distance provider. This was done without her knowledge or authorization. Complainant requests that steps be taken to prevent the changing of long distance companies without authorization; that she be absolved from any and all expenses for long distance service that she did not request; and that any party found to be at fault for slamming be fined.

CT01-036 In the Matter of the Complaint filed by Barbara Anne Schock, Sioux Falls, South Dakota, against Direct One Com.Long Distance Regarding Unauthorized Billing for Services.

Complainant states that her credit card was charged by Direct One Com.Long Distance for unauthorized billing. Complainant believes that her credit card was fraudulently accessed by Direct One Com.Long Distance after she purchased an item that was offered on television. Complainant requests that she be compensated for her time in resolving this matter and that she be awarded $1,000.00 as stated by South Dakota law. She also would like the Commission to assess a penalty on Direct One Com.Long Distance for its actions and because Direct One Com.Long Distance does not have a Certificate of Authority from the SD Public Utilities Commission.

CT01-037 In the Matter of the Complaint filed by Gerald Larson, Beresford, South Dakota, against Beresford Municipal Telephone Company, AT&T Communications of the Midwest, Inc. and T-NETIX Telecommunications Services, Inc. Regarding Unauthorized Collect Call Charges.

Complainant reported that he put a collect call block on his telephone to prevent calls from a correctional facility. The block failed to block calls from the correctional facility and complainant has received a bill for calls and he refuses to pay it. Complainant is requesting that he should not be liable for the charges since he took the proper steps to block collect calls.
