CT00-085 In the Matter of the Complaint filed by Fr. Yvon Sheehy, SCJ, on behalf of St. Mary's Catholic Church, Lower Brule, South Dakota, against Business Options, Inc. Regarding Unauthorized Switching of Services and Unauthorized Billing for Services.

The complainant alleges that on June 20, 2000, a bill for $198.29 was received with unauthorized long distance charges for a period from January 24, 2000 to May 19, 2000. The complainant requests that the company should be charged with a slamming violation for the time and undue stress this has caused the church office and hopefully this will prevent others from having to go through this.

CT00-086 In the Matter of the Complaint filed by Denise Nguyen, Rapid City, South Dakota, against Qwest Communications, Inc. Regarding Unauthorized Switching of Services.

The Complainant claims that her telecommunication services were switched without her authorization. Attempts to resolve the complaint were unsuccessful. The Complainant is seeking fines and penalties to stop the company's practice.

CT00-087 In the Matter of the Complaint filed by Joyce Ferris on behalf of Ferris Crane Service and Midwest Recycling Center, Huron, South Dakota, against Qwest Communications, Inc., Preferred Billing and USBI Regarding Unauthorized Switching of Services.

Complainant alleges that she was talked into changing her long distance services to Qwest through deceptive practices and that she did not authorize the switch to Qwest. She also alleges that she did not authorize Preferred Billing to switch her long distance services. She requests that the companies be liable for the wages of the PUC staff and any costs of changing back to her phone company, including the charges on her phone bill, since she did not ask for their services.

CT00-088 In the Matter of the Complaint filed by Curt and Jody DeWitt on behalf of DeWitt Homes, Brandon, South Dakota, against Sprint Communications Company L.P. Regarding Unauthorized Switching of Services.

The Complainants indicate that they were notified by their local carrier that their long distance service had been switched. The Complainants claim that they did not authorize the change. They are requesting $1000 for compensation.

TELECOMMUNICATIONS

TC99-086 In the Matter of the Filing for Approval of a Third Amendment to the Interconnection Agreement between DSLnet Communications, LLC and U S WEST Communications, Inc.

On April 12, 2000, an amendment, termed a "second" amendment to an interconnection agreement between DSLnet Communications, LLC and U S WEST Communications, Inc., has been filed with the Commission for approval pursuant to 47 U.S.C. Section 252(e). The interconnection agreement amends a prior agreement approved by the Commission on September 23, 1999 in docket TC99-086. The amendment purports to allow DSLnet to access certain preexisting combinations of unbundled network elements in accordance with the FCC's November 5, 1999 Order and related federal regulations. It will add terms, conditions and rates with regard to unbundled network elements.

A first amendment was later filed on June 5, 2000, to the interconnection agreement between DSLnet Communications, LLC and U S WEST Communications, Inc. This amendment adds provisions which include UDIT, ADSL and line conditioning and associated rate elements.

On July 19, 2000, the Commission received a third amendment to the agreement between DSLnet Communications, LLC and U S WEST Communications, Inc. (Now Qwest Corporation). This third amendment adds provisions to allow DSLnet to add terms and conditions with regard to LIS Inter Local Calling area (LCA) Facility and terms and conditions and rates with regard to Unbundled Dark Fiber. Any party wishing to comment on the third amendment may do so by filing written comments with the Commission and the parties to the amendment no later than August 8, 2000. Parties to the amendment may file written responses to the comments no later than twenty days after the service of the comments.
