CONSUMER COMPLAINTS
On October 21, 1999, the Commission received a formal complaint from Marilyn Taylor, Fort Pierre, South Dakota, against AT&T regarding billing issues. Complainant alleges when she was contacted by AT&T for long distance service, she requested instructions on using access codes for instate long distance. The Complainant further alleges that the AT&T representative indicated no access code was needed. As a result of those instructions, the Complainants intraLATA calls were billed by U S WEST at a much higher rate. The Complainant claims she was also promised 180 free minutes of calling which she did not receive. For relief, the Complainant believes AT&T should either pay $433 to U S WEST for those calls plus $27 for the free minutes not received.

On October 25, 1999, the Commission received a formal complaint from David and Lisa Neuharth of Fort Pierre, South Dakota, against Excel Telecommunications for unauthorized billing for services. Complainants indicate that the telephone located in their ranch bunkhouse was put "on vacation" by Golden West at the complainants' request. That phone remains on vacation. The Complainants allege that they received a welcome letter from Excel Telecommunications addressed to Ranch Tenant on October 19, 1999. The Complainants contend that they did not authorize those services.

On October 25, 1999, the Commission received a formal complaint from Lynne and Rod Flint, Doland, South Dakota, against MCI WorldCom for unauthorized switching of services. Complainants allege their long distance provider was switched without their authorization. Complainants request that the $1000 fine be awarded to them, all charges to their account be removed, and that the Commission impose a fine.

On October 26, 1999, the Commission received a complaint from Lynda Sederstrom of Madison, South Dakota, against Sprint regarding unauthorized switching of services. The complainant alleges that her instate long distance provider was switched without her authorization. The complainant is requesting a credit to her phone bill for any Sprint charges. The complainant is also seeking any damages allowed under South Dakota Laws, rules or policies for unauthorized switching of services.

TELECOMMUNICATIONS
U S WEST Communications, Inc. and AT&T Communications of the Midwest, Inc. filed a First Amendment to their Interconnection Agreement for Commission approval. The First Amendment is negotiated between the parties and replaces, in it's entirety, Attachment 1, Section 2.2 of the Resale Rates and Charges section. Specifically, the amendment provides that the wholesale discount rate is 15.55% for services subject to the wholesale discount and includes billing and collection, operator services, and directory assistance. If AT&T provides its own operator and directory assistance the discount must be reduced by 2.68%; for AT&T provided billing and collection, the discount is reduced by.06%.
Any party wishing to comment on the amendment to the agreement may do so by filing written comments with the Commission and the parties to the amendment no later than November 16, 1999. Parties to the amendment may file written responses to the comments within twenty days of service of the comments.
