MINUTES OF THE AD HOC COMMISSION MEETING

Chairman Chris Nelson called the meeting to order. Present were: Commission Counsel: Rolayne Wiest; Commission Advisor: Greg Rislov; Staff Attorneys: Kristen Edwards and Adam de Hueck; Staff Analyst: Lorena Reichert; and Staff: Katlyn Gustafson.

Also present were:
Mr. Rich Coit, South Dakota Telecommunications Association; and Darla Rogers, Riter, Rogers, Wattier & Northrup, LLP, representing Venture Communications Cooperative.

Joining the meeting by telephone were:
Commissioners: Kristie Fiegen and Gary Hanson; and Pat Mastel, Midcontinent Communications;

Telecommunications

1.     TC15-063     In the Matter of the Application of Midcontinent Communications for an Amended Certificate of Authority and for a Waiver of ARSD 20:10:32:15 (Staff Analyst: Lorena Reichert; Staff Attorney: Kristen Edwards)

     Commissioner Nelson moved to approve the Stipulation for Partial Settlement, MidContinent's Amended Certificate of Authority, and waiver of ARSD 20:10:32:15. Motion carried 3-0.

2.     TC15-065     In the Matter of the Approval of a Wireline Interconnection Agreement between Qwest Corporation dba CenturyLink QC and Vitcom LLC (Staff Analyst: Lorena Reichert; Staff Attorney: Adam de Hueck)

Mr. Adam de Hueck, staff attorney, recommended that the Commission not approve the agreement as Vitcom LLC does not have a Certificate of Authority to provide telecom service in South Dakota. Ms. Lorena Reichert, staff analyst, added that Vitcom has filed a pending Certificate of Authority with the Commission and that the Vitcom can refile the agreement.

     Commissioner Nelson moved to deny the agreement without prejudice.Motion carried 3-0.

There being no further business, at the hour of 4:17 p.m. the South Dakota Public Utilities Commission meeting adjourned.
