1.     Status Report on Consumer Utility Inquiries and Complaints Received by the Commission (Consumer Affairs: Deb Gregg)

Electric

1.     EL17-020     In the Matter of the Joint Request for an Electric Service Territory Boundary Change between Northern States Power Company dba Xcel Energy and Sioux Valley-Southwestern Electric Cooperative, Inc. dba Sioux Valley Energy (Staff Analyst: Lorena Reichert; Staff Attorney: Amanda Reiss)

On May 1, 2017, the Commission received a joint request from Northern States Power Company dba Xcel Energy and Sioux Valley-Southwestern Electric Cooperative, Inc. dba Sioux Valley Energy seeking to modify existing service territory boundaries in Sioux Falls, South Dakota. On May 19, 2017, Ronning Enterprises, Inc. filed a Petition to Intervene.

     TODAY, shall the Commission grant intervention to any parties that may have filed? OR, how shall the Commission proceed? 

2.     EL17-023     In the Matter of the Joint Request for Service Rights Exception between Dakota Energy Cooperative, Inc. and Northern Electric Cooperative, Inc. (Staff Analyst: Lorena Reichert; Staff Attorney: Amanda Reiss)

On May 9, 2017, the Commission received a Joint Request for Service Rights Exception between Dakota Energy Cooperative, Inc. (Dakota Energy) and Northern Electric Cooperative, Inc. (NEC) to allow NEC to provide electric service to a card toll fueling station at Bonilla, SD, located in Dakota Energy’s territory. Under the service rights exception, Dakota Energy does not consent to the extension of service to any other customer or facility besides the card toll fueling station.

     TODAY, shall the Commission approve the requested service rights exception between Dakota Energy Cooperative, Inc. and Northern Electric Cooperative, Inc.?

Natural Gas

1.     NG17-007      In the Matter of the Filing by MidAmerican Energy Company for Approval of Its 2016 Economic Development Activities and 2017 Proposed Budget (Staff Analyst: Joseph Rezac; Staff Attorney: Kristen Edwards)

On May 1, 2017, MidAmerican Energy Company (MidAmerican) filed its 2016 Economic Development Activities and Proposed 2017 Budget for Commission approval. The filing included MidAmerican’s report on 2016 economic development activities, actual expenses for 2016, and the planned budget for 2017.

     TODAY, shall the Commission approve MidAmerican’s 2016 Economic Development Activities and Proposed 2017 Budget?

Telecommunications

1.     TC14-019     In the Matter of the Petition of Blue Jay Wireless, LLC, for Designation as an Eligible Telecommunications Carrier (Staff Analyst: Eric Paulson; Staff Attorney: Kristen Edwards)

On May 23, 2014, the Commission received a Petition for Designation as an Eligible Telecommunications Carrier from Blue Jay Wireless, LLC for the purpose of offering Lifeline services on a wireless basis throughout a majority of South Dakota, in both rural and non-rural areas pursuant to Section 214(e)(2) of the Federal Communications Act of 1937, as amended, Section 54.201 et seq. of the Rules of the Federal Communications Commission, and South Dakota Administrative Rule 20:10:32:42. On June 26, 2014, the South Dakota Telecommunications Association (SDTA) was granted intervention. On January 16, 2015, Blue Jay Wireless, LLC filed a Motion to Bifurcate, which was granted by the Commission on February 4, 2015. Bifurcation allowed the parties to proceed on the rural and non-rural areas separately. On May 31, 2017, Staff filed a memo regarding the dismissal of the docket.

     TODAY, shall the Commission dismiss and close the docket without prejudice? OR, how shall the Commission proceed?

2.     TC17-001     In the Matter of the Application of Wide Voice, LLC for a Certificate of Authority to Provide Local Exchange and Interexchange Long Distance Services in South Dakota (Staff Analyst: Patrick Steffensen; Staff Attorney: Kristen Edwards)

On January 12, 2017, the Commission received an Application for a Certificate of Authority from Wide Voice, LLC (Wide Voice). Wide Voice seeks to provide competitive local exchange services, including exchange access service, and interexchange long distance services within the state of South Dakota. On February 3, 2017, Wide Voice responded to Staff’s first set of data requests. At its regularly scheduled meeting on February 10, 2017, the Commission granted intervention to the South Dakota Telecommunications Association (SDTA) and South Dakota Network, LLC (SDN). On May 19, 2017, Wide Voice responded to Staff’s second set of data requests. On May 23, 2017, the Commission deferred this docket until the next scheduled Commission meeting. A Settlement Stipulation between Wide Voice, SDTA, and SDN is expected to be filed prior to the Commission meeting.
  
     TODAY, shall the Commission grant Wide Voice’s request for a Certificate of Authority to provide Local Exchange and Interexchange Long Distance Services in South Dakota? AND, shall the Commission grant Wide Voice, SDTA, and SDN’s request to include the terms and conditions as set forth in the Settlement Stipulation?

3.     TC17-009     In the Matter of the Application of ExteNet Systems, Inc. for a Certificate of Authority to Provide Local Exchange Services in South Dakota (Staff Analyst: Eric Paulson; Staff Attorney: Amanda Reiss)

(ExteNet) requesting a Certificate of Authority to provide local exchange services in South Dakota to operate as a wholesale provider of competitive local exchange services, specifically non-switched dedicated Point-To-Point Private Virtual Circuit Transport Service. On May 5, 2017, the South Dakota Telecommunications Association (SDTA) was granted intervention. On April 21 and May 3, 2017, ExteNet responded to Staff’s data requests. On May 22, 2017, SDTA and ExteNet filed a Joint Stipulation.

     TODAY, shall the Commission grant ExteNet’s request for a Certificate of Authority to provide telecommunications services in South Dakota and requested waiver? AND, shall the Commission grant SDTA and ExteNet’s request to include the terms and conditions as set forth in the Joint Stipulation?

  1. Commissioners will attend the Sioux Valley Energy Annual Meeting on Tuesday, June 6, 2017, beginning at 6:30 p.m. CDT at the Brandon Valley High School, Brandon, S.D.

  2. The next regularly scheduled commission meeting will be Friday, June 16, 2017, at 8:30 a.m. CDT in Room 413 at the State Capitol Building, Pierre, S.D.

  3. Commissioners and staff will attend the Mid-America Regulatory Conference annual meeting June 18-21, 2017, at The Swissotel, Chicago, Illinois.

  4. Commission meetings are scheduled for July 5 and 21, 2017.
