MINUTES OF THE AD HOC COMMISSION MEETING

Chairman Chris Nelson called the meeting to order. Present were: Commissioner: Gary Hanson; Commission Counsel: John Smith; Commission Advisor: Greg Rislov; Staff Attorneys: Karen Cremer and Kristen Edwards; Staff Analysts: Darren Kearney and Brian Rounds; and Staff: Katlyn Gustafson.

Also present were:
Cheri Wittler, Court Reporter.

Joining the meeting by telephone were:
Commissioners: Kristie Fiegen and Gary Hanson; Jennifer Baker, Fredericks Peebles & Morgan LLP, representing Yankton Sioux Tribe; Travis Clark, Fredericks Peebles & Morgan LLP, representing Cheyenne River Sioux Tribe; Bruce Ellison, Ellison Law Office, representing Dakota Rural Action; Matt Rappold, Rappold Law Office, representing Rosebud Sioux Tribe.

Hydrocarbon Pipeline

1.      HP14-001     In the Matter of the Petition of TransCanada Keystone Pipeline, LP for Order Accepting Certification of Permit Issued in Docket HP09-001 to Construct the Keystone XL Pipeline (Staff Analysts: Brian Rounds, Darren Kearney; Staff Attorney: Kristen Edwards)

On July 10, 2015, the Commission received Keystone's Protective Motion in Limine Regarding Dakota Rural Action's Exhibit List Dated July 7, 2015 (Motion). In its Motion, Keystone sought an order prohibiting DRA from offering any exhibit or testimony regarding exhibits containing information not timely produced in supplementary discovery responses. A lengthy discussion took place regarding the Motion.      Commissioner Nelson moved to grant Keystone's Protective Motion in Limine Regarding Dakota Rural Action's Exhibit List Dated July 7, 2015 as it relates to exclusion of Dakota Rural Action’s Exhibits 29-37, 39-65, 67-128, 397-409, 1058-1062, and 1063-1073. Motion carried 3-0.
        
There being no further business, at the hour of 2:15 p.m. the South Dakota Public Utilities Commission meeting adjourned.
