South Dakota Public Utilities Commission Meeting

MINUTES OF THE AD HOC MEETING

Chairman Jim Burg called the meeting to order. Present were Commissioner Pam Nelson, Commissioner Laska Schoenfelder, Executive Director Bill Bullard, Commission Advisor Greg Rislov, Commission Counsel Rolayne Ailts Wiest, Staff Attorneys Karen Cremer and Camron Hoseck, Utility Analyst Michele Farris and Administrative Secretary Shirleen Fugitt.

Also joining the meeting was Lori Grode, Pierre Court Reporting.

Joining the meeting by phone were Colleen Sevold and Alex Duarte, U S WEST; Bill Heaston and Barb Berkenpas, DTG.

Telecommunications

1. TC99-113 IN THE MATTER OF THE PETITION OF MCLEODUSA TELECOMMUNICATIONS SERVICES, INC. FOR A DECLARATORY RULING ON WHETHER THE DISCONTINUANCE OF THE RETAIL SALE OF VOICE MESSAGING SERVICE BY U S WEST COMMUNICATIONS, INC. TO MCLEODUSA VIOLATES SDCL 49-31-11. (Staff Analyst: Harlan Best. Staff Attorney: Camron Hoseck.)

Chairman Burg moved that the Commission deny McLeod's Petition for Declaratory Ruling which requested that the Commission find that U S WEST's disconnection and denial of Voice Messaging Service to McLeod violates SDCL 49-31-11. Chairman Burg further commented that he believes that Voice Messaging Service is not a telecommunications service as defined by SDCL 49-31-1(27) and that, therefore, 49-31-11 does not apply because it references only telecommunications services. Commissioner Nelson seconded and Commissioner Schoenfelder concurred. Motion passed 3-0.

The meeting was adjourned.
